The point is you want the fed law followed when it suits you, or the state to make their own law instead when it suits you.

Stop having multiple personalities.







You brought up implementing laws of federal law.   Just cause you don't like the implementation law, doesn't make MJ any more legal.   The two are not related.  The voters brought in the MJ law.   Not the politicians.   I personally voted against it.   Think it is stupid.   If it should be legalized then do it right.   The voters don't set health standards   they hire people to do that for us.

But in all seriousness.   I do think that if the people did decide to legalize everything, then we could put the drug cartels out of business (or at least make them change their business plan), and stop a lot of the violence in Mexico and along our border.

You want to pick and choose what issues you wish the State to leave to the Fed and those where you wish the State to ignore the Fed.

That is like you may be required to have a safety program under one or the other.   It implements the law

I read that as the implementation of Federal Law, which is required by the same federal law.    Did I lose something.   Oh yeah.   You want people to come into the country in violation of our laws (least it looks like that to me).


As I've patiently explained to you before the states do not get to enforce federal laws.

State authorization is a rulemaking process through which EPA delegates the primary responsibility of implementing the RCRA hazardous waste program to individual states in lieu of EPA. This process ensures national consistency and minimum standards while providing flexibility to states in implementing rules. Currently, 50 states and territories have been granted authority to implement the base, or initial, program. Many are also authorized to implement additional parts of the RCRA program that EPA has since promulgated, such as Corrective Action and the Land Disposal Restrictions. State RCRA programs must be at least as stringent as the federal requirements, but states can adopt more stringent requirements as well.

YOU want Arizona to follow the federal law you like and do what they wish on the fed laws you don't approve of.

ROFLACGU    I was only being funny to DomKen   lol   who said states don't enforce Fed Law.   LOL   I whole heartedly like RCRA.   One thing that I found funny.   The very first sanitary landfill in the US a listed historical site, is also a SUPERFUND site (and has to be removed).    Both are Federal requirements beating against each other.   In the mean time the ground is shrinking as the stuff deteriorates.

I believe that the number is sixteen states who have.  About a third.

IF they could find a way to get pot legal and still get elected... [;)] Too many politicians are more concerned about their own wallets and getting re-elected.

I can't blame the colleges on this one.If they do not enforce the Federal laws,then they lose out on their funding.Besides,people really shouldn't be smoking pot while they are suppose to be learning anyways.Alcohol is legal but I do not think drinking and then studying works out that well anyways.If they want to do their "thing",then at least do it off campus and during off time.

I don't really view marijuana as a liberal vs conservative issue.I have known people from all walk,smoke pot.So,put aside the foolish "liberaL" comments when its comes to those who smoke pot.Besides,I thought it was conservatives who preach smaller government and having more freedom.Or is all that a lie,that goes up in smoke?

The FDA is the one that approves drugs for market.   If they approve it then it would be legal.

The FDA is the one that approves drugs for market.   If they approve it then it would be legal.



Nope.

The DEA currently tracks it because it is an illegal drug.  In the event that the DEA decided to decriminalize it, it would then become a legal drug and the FDA would have jurisdiction.  The determination of whether a drug is legal or not is the DEA's call, not the FDA's.

Edited to add: You are correct that the FDA approves drugs for market.  However, when they do, they test drugs that are not approved and not in use, to check efficacy and absence of side effects.

In the event that the DEA decriminalized marijuana, I expect that the FDA would conduct the exact same tests.

I think the fact that any pharmaceutical company who tried to patent cannibis sativa wouldn't get very far doing that might have something to do with it as well.

(That said, pot is one hell of a cash crop. It is strange that the Feds would rather all the money that's spent on it go straight to vile pondlife in central america and asia than get a tax bite out of it...)
