The determination of whether a drug is legal or not is the DEA's call, not the FDA's. Edited to add: You are correct that the FDA approves drugs for market. However, when they do, they test drugs that are not approved and not in use, to check efficacy and absence of side effects. In the event that the DEA decriminalized marijuana, I expect that the FDA would conduct the exact same tests.
