Now there's a story bound to be a hit at a family reunion, with Granny and all the Aunts and Uncles around !
But all kidding aside, that is what a jury is for. The function of a jury is not only to determine guilt or innocence, but to moderate or nullify the application of written law as they see fit. Like it or not, that is what they did.
Let's say they bust somebody growing pot. Now to over hear the jury, let's say someone like me is seated.
"Did they say something about him growing AK47"
"I wonder who was moving it for him"
"I wonder if I know anyone who can get into the property room so we can "test" the evidence firsthand"
"Did you see that lighting system ? I know those things cost alot of money"
Really, I have no desire to fuck a horse. What I think about it does not matter though. That jury did exactly what juries are supposed to do. Like it or not.
Beastiality is pretty fucking sick IMO. I am not talking about the horse. Now if the horse got up in court and claims rape that is different, but it probably didn't really care, and who knows might have enjoyed it. I think beastialty is sick because of the motivations behind it. But Man to horse is not abuse.
So as sick as it might be I would have to acquit. However in this case IIRC it was someone else's horse ? Perhaps a lesser conviction would be in order, criminal trespass ?
If that behavior is acceptable in that area - their society - their neck of the woods, then so be it. Maybe that's why so many rapes happen in urban areas, there are simply not enough farm animals around.
Radical thinking ? Of that there is no doubt, but as a juror I would be charged with judging law as well as fact. The first reference in my mind would be the Constitution, and just what rights were violated, and remember animals do not have rights. I would have to apply the law, the REAL law and as such, my personal opinion can only have weight under these constructs.
They don't ever want me on a jury. Maybe I would be alone in my thinking, but at least it would result in a hung jury. I would never convict anyone for drugs, nor for any violence if it were self defense, and a few other things. No, the PTB do not want me there at all.
My sinister, oops sister seems to gets called alot for jury duty and I have made her aware of these facts. One day they will probably stop calling her. Last time though she helped convict a rapist. Well that is different. I think if the guy had raped a mule she would have been ROFL. But this was a person. This is to be taken seriously.
All these jokes around you'll probably never see on CM about this shit, almost implies that in some cultures this practice is acceptable. If so, let them apply their own moral standards to the case. Another fine example of how real justice works.
Even pedophiles, define that. Where exactly is the line drawn for statutory rape ? Well it varies from state to state. Are the people that different ? In some states if you are 22 and your date is 17 you go away, and are labelled for the rest of your life. In other states you can be 50 and actually marry your 15 year old cousin.
In other words that is what juries are for. They try to make laws one size fits all, and that is simply impossible.
And contrary to popular belief, many countries have jury trials. It is not a US exclusive.
I can just imagine the jury down there "Yeah I think they shit when they get off Clem". Imagine overhearing that.
Now if the guy was fucking a rabbit it would clearly be a case of animal abuse because of the size of..........
