Yes ... battery is the actual force and hitting, etc ... CONSENSUAL battery is legal in Texas.
Assault ... the threat of using force on another is still illegal

This is why My Doctor knows about bishop and I.
I have had bishop go to appointments to meet the Doc.
That way the Doc can testify that W/we have a loving relationship,and the bruised up butt was all in fun.

I know that the state of Maine will often Prosecute on the behalf of the "injured" person even if they dont file charges.They will call the "victim" a hostile witness.

Let me throw something in addition to my last reply, for the sake of completeness.

As far as I know, in terms to what I said about consenting to assault, (or battery for that matter), there hasn't been a case to test that theory. And I'm pretty sure there aren't many that are willing to be a test case. :)

What is to stop us from talking to our doctors and making them kink-aware? As I said above, you can do people in your local community a big favour and encourage your doctor to be kink-aware. They don't have to be willing to be on the list. Word-of-mouth at munches and play parties would get the job done.

We don't need to be passive and wait for the world to come to us, we can go out there, and advocate for our rights. Talking to your family doctor is a great act of empowerment towards a better kink-friendly life.

i dnt belive most health professionals will alert the police if the patient says such bruises are consensual, after all, pretty many pepole knows BDSM is out there.

I once had a fairly heavy play session on a Friday night, and completely forgot I had a gyno appointment the following Monday My butt was quite bruised by then but the male doctor never mentioned it. I don't know if he even made any notes about it. Master had told me, if anything was said, just to say that I was into having "rough sex" and that it was consensual.
