Marini -> University of Cincinnati Police Officer Indicted (7/29/2015 3:23:35 PM)

Well, since no-one bothered to start a thread on the breaking news on ALL the news channels, here we go.

University of Cincinnati Police Officer Indicted for murder in the shooting of Samuel DuBose!!!

[sm=applause.gif]

Yes, yes, yes for body cams on ALL police officers AND I say put 2 or 3 camera's inside AND outside ALL police cars for good measure!

This is the ONLY way to curtail the epidemic of people who are shot or killed because they were DWB.

I am sorry this happened to Samuel DeBose, but elated it was all caught on tape and the perpetrator has been indicted!
*The officer indicated {Ray Tensing} could face up to life in prison.

We will never know how many innocent people have been killed prior to these camera's!!
May all the people of all races, killed for little/or no reason by despicable rogue police officers, RIP!

Yes, until those police involved are truly held responsible, this will continue.

Mr. Rodgers, with the body cams and the video camera's in the squad car's, hopefully the number of these incidents will decline.

That is the point of having body cams and video camera's.
It protects everyone involved.

Its the police via the courts. lets not forget the people who gave them permission by always ruling in favor of the state in these kinds of cases. remember the courts rule this country and when we read cases like mimms and others we turn away in shock how easily they slice through the constitutionally reserved rights with narrow opinions under the guise of 'officer safety'.

Keep in mind, as I just posted as we seen in the Bland incident how the officer asked her to go out of site of the cam where we heard her screaming in pain etc etc.

There also needs to be nationwide laws that everything the officer does must be on cam or it gets thrown out. If its not on cam they will figure out a way to abuse it in a manner that no one can prove otherwise. again as in the bland incident.

Well but so far...apparently not.

I just hope they're not over-charging and inviting an acquittal. All Tensing knew was that the guy was acting squirrely, and it doesn't require any stretch of the imagination to think that might be because there were warrants out on him and that he could be dangerous, or the car could be stolen. And, the name DuBois gave him could have been false. So it seems to me perfectly reasonable in the circumstances to have the guy exit the vehicle, and to cuff him while his story is being checked. DuBose's attempt to flee at that point would have confirmed any cop's worst suspicions.

Tensing wasn't dragged, but he was going to be unless he let go. He only fired after DuBose ignored his lawful order to "Stop!" and he still ended up on the ground. Granting that disobeying a lawful order doesn't carry the death penalty and that Tensing had no certain knowledge that DuBose was a dangerous felon, proving a murder charge under Ohio statutes requires proving intent to kill, to "purposely cause the death of another," and it may not be a cakewalk to prove beyond a reasonable doubt that Tensing intended to kill DuBois, and didn't just fire with the intent to stop him.

It's still a bad shoot, but it may also be a bad charge. Meanwhile, what the fuck is going on in the heads of people who court their own destruction by resisting arrest and disobeying lawful orders? Putting Tensing in jail isn't going to bring that family's father back.

For goodness sake K you really are scraping the barrel here.

The cop fired a bullet into his head at point blank range. No one does that without an intent to kill because that's is the very predictable outcome of firing bullets into a person's head at point blank range.

The degree of 'provocation' was negligible, and by your own account amounts to nothing more than unconfirmed suspicions, none of which have been shown to have any basis or justification.

If you support cops killing people on suspicion, then Tensing is your kind of cop. Most of us, I imagine, would prefer that cops refrain from using lethal force except in situations where it is the only option. Clearly this was not such a situation. It was at worst a minor traffic violation that turned bad because the cop (for some reason) chose to kill Du Bois rather than shooting out one of his tyres.

I wouldn't want to live anywhere where such choices by cops are supported by the community.

You're assuming it was an aimed shot. From the look of it on the video the cop was losing his footing when he fired. He may not even have intended to pull the trigger. Odd as it may seem to you, most people tend to become cooperative when you point a gun at them.

Don't you have any insect friends to play with? I said it was a bad shoot. Whether a murder charge can be sustained is a separate matter.

Uh, since he didn't blow his own head off K, one would think that at least subconciously he was aligning the general direction of an aim. and in the head at point blank range, it doesnt require calculus and trajectory tables...........

Jus sayin

Well okay, but the legal term for "subconscious murder" is acquittal.

K.

mnottertail -> RE: University of Cincinnati Police Officer Indicted (7/30/2015 10:15:18 AM)

I would think it would be more along the lines of accidental manslaughter, or unpremeditated murder (like 3rd degree). It would meet more of the necessary and sufficient conditions of the definition than say the word acquittal would.

It would if that's what they were charging him with. That's what I meant about overcharging.

Based on recent events, they might be thinking "It's him or me."

Reading (and I just saw you with the aiming thing scrolling by) and have not seen the movie or read the book, if nothing else I know from what I have understood based on your post is:

Negligent Homicide.
Reckless Homicide.

ChatteParfaitt -> RE: University of Cincinnati Police Officer Indicted (7/30/2015 10:46:13 AM)

There's so much more going on here. Another officer claimed that Deters was dragged when the video clearly shows he was not.

kdsub -> RE: University of Cincinnati Police Officer Indicted (7/30/2015 11:09:36 AM)

What is a university security officer doing trying to enforce a state ordnance? I have not seen the video...was he being dragged along when he shot?

Butch

ChatteParfaitt -> RE: University of Cincinnati Police Officer Indicted (7/30/2015 11:25:31 AM)

He was not dragged. The video clearly shows (and you hear) the officer running behind the car which rolled after he killed the man.

kdsub -> RE: University of Cincinnati Police Officer Indicted (7/30/2015 11:54:03 AM)

I just watched it... I could not tell... it looked at first like he was being dragged then running...but either way he was just a rent a cop... he had no right to kill someone.

Butch

ChatteParfaitt -> RE: University of Cincinnati Police Officer Indicted (7/30/2015 12:00:39 PM)

He most certainly didn't have the right, and his buddies who lied for him are in the wrong as well. As far as I'm concerned they should be indicted along with him.

That would *really* send the proper message -- that killing someone b/c you had a bad day or got pissed off at them has consequences.
