DUBUQUE, Iowa -- Joshua Duehr is one of more than 50 sex offenders in Iowa who can carry a gun in public.

"I don't leave the house without one," said Duehr, who lives in Dubuque.

It's legal — and it's news that has surprised some state lawmakers and alarmed a few Iowa and national law enforcement officers.

An FBI official, the president of the Iowa State Sheriffs' & Deputies' Association, the president of the Iowa State Police Association and two state lawmakers told The Des Moines Register they have public safety concerns after learning that a two-year-old state law on gun permits allows registered sex offenders to obtain a weapons permit.

"It does seem to go contrary to what the whole point or the whole purpose" of the sex offender registry is, said Steve Conlon, the deputy unit chief of the FBI Behavioral Science Unit's Evil Minds Research Museum in Quantico, Va.

Conlon, a former assistant director of the Iowa Division of Criminal Investigation who previously oversaw the state's sex offender registry, said he will confer with other law enforcement officials on this issue.

"I've never even heard of anybody looking into this arena," Conlon said. "You're in some unchartered grounds."

Some, if not most, applications by sex offenders for permits to carry weapons would have been denied by county sheriffs before 2011, according to officials from the Iowa Department of Public Safety. But sheriffs no longer have discretion to reject such applications.

The law change means people convicted of misdemeanor sex crimes can now walk the streets, malls or virtually any public place in the state while carrying a gun. Almost all of the sex offenders on the Register's list were convicted of misdemeanors such as lascivious conduct with a minor or assault with intent to commit sexual abuse.

But the Register found three men convicted of felony sex crimes who had permits to carry weapons in public. Two of those men had their permits revoked by sheriffs after the Register asked about their situations.

"My concern of a sex offender having a gun is they try to typically rule in a bullish way to influence people — and just the presence of a gun on a hip could be a threat to get people to cooperate," said Washington County Sheriff Jerry Dunbar, who is president of the Iowa State Sheriffs' & Deputies' Association.

"They intimidate to get what they want."

Some sheriffs were aware that sex offenders are carrying weapons in public, primarily because they issue the permits and have firsthand knowledge about the issue.

But other professionals in Iowa's law enforcement community were caught off guard.

Rob Burdess, a Newton police detective and the president of the Iowa State Police Association, was unaware that sex offenders are being issued weapon permits until he was asked about it by the Register.

He noted that people with felonies or domestic abuse convictions are typically unable to obtain weapon permits, so he questions the logic of allowing sex offenders — even those convicted of non-felony offenses — to carry weapons in public.

Someone can get convicted as a sex offender if they took a leak by the side of the road. By lumping these people in with violent rapists under the "sex offender" label, this kind of stupid stuff is inevitable.

If someone is convicted of a felony, sexual offender or not, they are prohibited from owning a gun.

I'd want to know more about the misdemeanor offenses before offering an opinion.

I agree with DS. There have been cases where teenagers have been busted texting naked pics to each other and end up having to register as sex offenders. I'm not taking the side of sex offenders but it can be a really broad brush. More information would help.

OTOH: I've seen reports of individuals who have been convicted and did their time then released, who have a very difficult time finding a place to live. And when they do they are often harrassed (anonymously) by people who don't want them in their neighborhood (a viewpoint I tend to agree with). And no, I'm NOT trying to defend all "sex offenders" here.

As DS said, let's see the specifics of the 50 people who were granted permits. Exactly what were their offences? Misdemeanors? Felonies? It makes a difference.

As an Iowan that sees firsthand many of the idiots that now feel the need to live their lives with a gun at arm's reach, whether or not said idiot is a sex offender, is of no relevance.

I can see this happening to a pregnant woman in her third trimester traveling along a highway. Apparently the law thinks she deserves a life sentence for not being able to hold it until she reaches the next rest stop. After the baby is born she becomes a sex offender with a child "gasp". IMO, an outrage such as this is comparable with some of the barbaric Sharia laws in Islam dominated Middle East countries.

    Crimes that are deemed sex offenses for registration purposes have been expanded under SORNA. Each state must decide which tier violations of state law belong to, depending on the following guidelines, and then enact statutes that tier each criminal offense.     Thus, an offender's tier under this scheme is based on the particular statute to which an offender plead guilty, or was convicted of. However, offenses must be punishable by imprisonment for more than 1 year (i.e. a felony) to be classified higher than Tier I.

    Tier III Offenses require lifetime registration and quarterly verification, involve:[26]

    • sexual acts involving force or carried out under threat, 18 U.S.C. 2241(a)[27]
    • sexual acts with one whom the actor causes unconscious, or impairs by drugging or intoxication, 18 U.S.C. 2241(b)[27]
    • sexual acts with a child under the age of 12, 18 U.S.C. 2241(c)[27]
    • sexual acts with one whom is mentally incapable of appraising, or physically incapable of declining, or communicates unwillingness of, the sex act, 18 U.S.C. 2242[28]
    • sexual contact with a child under the age of 12, 18 U.S.C. 2244(c)[29]
    • non-parental kidnapping or false imprisonment of minors,
    • any attempt or conspiracy to commit of any of the above, and
    • any new offense committed by a Tier II offender.

    Tier II Offenses require registration for 25 years and semiannual verification. It generally consists of nonviolent sex offenses, involving minors:[26]

    • sex trafficking of minors, 18 U.S.C. 1591[30]
    • transportation of minors with intent to engage in criminal sexual activity, 18 U.S.C. 2423[31]
    • coercion and enticement (Mann Act), 18 U.S.C. 2422(b)[32]
    • sexual acts with minors age 12-15, 18 U.S.C. 2243(a)[33]
    • sexual contact with minors age 12-15, 18 U.S.C. 2244[29]
    • sexual offenses involving those in custody, and the actor has custodial, supervisory, or disciplinary authority, 18 U.S.C. 2243(b)[34]
    • offenses where minors are used in prostitution,
    • offenses where minors are used in sexual performance,
    • offenses involving the production or distribution of child pornography,
    • any attempt or conspiracy to commit of any of the above, and
    • any new offense committed by a Tier I offender.

    Tier I Offenses require registration for 15 years and annual verification. This tier is for sex offenses that do not fall into the higher tiers, and includes both felonies and misdemeanors. States can include any conduct that by its nature is a sex offense, although Tier I is generally reserved for nonviolent offenses where the victim has reached the age of consent:

    • sexual contact without permission, 18 U.S.C. 2244(b)[29]
    • offenses involving simple possession of child pornography,
    • offenses involving public indecency (some states limit this to where the victim is a minor),
    • offenses involving voyeurism, 18 U.S.C. 1801[35]

    The required retroactive application of requirements will be defined by criteria relating to the nature of their sex offenses. For example a tier 3 sex offender who was released from imprisonment for such an offense in 1930 will still have to register for the remainder of their life. A tier 2 sex offender convicted in 1980 is already more than 25 years out from the time of release. In such cases, a jurisdiction may credit the sex offender with the time elapsed from his or her release.

    Sex offender registration has been applied to crimes other than rape, child molestation, and child pornography offenses.
    In Connecticut, those with state convictions for certain misdemeanors have to register, including: Public Indecency, in violation of C.G.S. § 53a-186, provided the court finds the victim was under 18; and Sexual Assault, 4th Degree, in violation of C.G.S. § 53a-73a.[36]
    In New York and various other states, crimes that society does not necessarily view as sexual in nature are also considered to be registerable sex offenses, such as kidnapping, "sexual misconduct", unlawful imprisonment, and in some cases "sexually motivated offenses" (such as assault, burglary, etc.) that are not categorized as sexual offenses unless the court determines that the offense was committed pursuant to the offender's own sexual gratification. In New York specifically, kidnapping and unlawful imprisonment are registerable offenses only if the victim is under 17 and the offender is not a parent of the victim.[37]
    In Kentucky, all sex offenders who move into the state and are required to register in their previous home states are required to register with Kentucky for life, even if they were not required to register for life in their previous residence.[38]

In the UK a pregnant woman can legally relieve herself anywhere she wants, including in a policeman's helmet,
edited to add, any cop or judge for that matter that would charge a pregnant woman as a sex offender is a douchetard of enormous proportions...

As far as I know in Missouri...forever...I'll bet Iowa is the same. Funny DarkSteven used that example because I've also seen this happen. On a company float trip on the Current River in Missouri a fellow worker of mine held our canoe up while he jumped off on a gravel bar...Ran to the edge of the woods and took a leak. Right next to him was a little boy also taking a leak. When we reached our takeout point there were police waiting who took him into custody for exposing himself to a minor. He is now on the list despite numerous attempts to have his name removed. It can happen to anyone.

Yup. In CA, public nudity and assisting in public nudity get you on the list for life. Lumping everyone into one label does not give an adequate description of individual situations.

A friend of mine, who is a police officer in the sex crimes unit, says the list doesn't work because of the wide ranging things that can get you on the list and the fact that minor offenses and non-risk individuals don't get removed from the list.

In CA. for life. They're not just on the sex offenders list, they're also on the website which means that they're on the list for something stupid, but the whole world knows where they live. There was one poor guy in Palm Springs that had his business ruined and home vandalized because someone in the neighborhood found a picture on the website that resembled his neighbor. He ruined his life and he had the wrong guy.

I'm probably going to get a lot of ridicule for saying this (I'm used to it on here anyway), but I think sex offender lists should be abolished. When someone is on the list, their entire family is often bullied, harassed, and ostracized. Did the sex offender's parents, siblings, or children commit the crime? With the harassment they're forced to endure, they may as well have. I also think many if not most people have done things in the past (urinating outside, streaking, mooning, making out or having sex in a car, high school teens having sex, etc.) that if caught today, could have landed them on the sex offender list. If truly dangerous (violent offenders, those who stalk daycares and elementary schools), keep them locked up. IMO we don't need lists that hurt more innocent people than they help.
