Rainey, an employee of Blue Ribbon Steak and Seafood, had just knocked on Roop’s door at 1815 SW 30th Terrace and gotten no response when Roop pulled into the driveway, driving a pickup, according to an arrest report released Thursday.

Explaining his actions to police after the shooting, Roop said he became “more than a little nervous” as Rainey walked down the driveway toward his truck and appeared to have something in his hand.

As Rainey drew within 4 feet, Roop grabbed his 9mm Glock from his pocket and fired once, striking Rainey in the shoulder, he told police. Rainey fell to the ground, screaming, ‘You shot me,’ in what Roop described as an “antagonistic” manner, according to the report.

Roop claimed that he was “still in fear” when he shot the wounded man in the back of the head “for effect,” whatever that means. Roop told police after his arrest that he killed Rainey without warning because, “I’m not going to give him the chance to do something to me; I was in fear.”

This is the world the NRA-owned GOP envisions; one in where we are so afraid of each other that we must carry a weapon at all time to feel the illusion of safety. A world where everyone is a potential threat is a world in which we cannot band together for the common good. The Castle Doctrine and “Stand Your Ground” laws were developed to make us afraid of the world beyond the walls of our “castle” and to free of us any moral considerations when deciding to blow away an unarmed man simply because he “might” have posed a threat.

The right-wing media will do their usual song and dance of this being an “ISOLATED INCIDENT” carried out by a crazy person, but is it a coincidence that he’s using the same words as George Zimmerman? I was afraid for my life against an unarmed person. He didn’t belong here. I felt threatened. These are not the words of people who feel any responsibility towards their fellow citizens; these are the words of people who have decided that they are center of the universe and everyone else is an intruder. These are the words of the right-wing.

Is this really the kind of country we want to live in?

Sad that any civilised nation has laws crass enough to allow this. The only reply to this from within the report is....wtf.

" Rainey fell to the ground, screaming, ‘You shot me,’ in what Roop described as an “antagonistic” manner, according to the report. "

It's a sad thing, but at least the deaths of these innocent victims will help to undermine the Government By Paranoia that Stand Your Ground represents. How many more will die before these laws are repealed? Quite a few, I'm afraid.

Missing from post #1, but in the link: "This Wednesday, in Cape Cod, Florida, Nicholas Rainey, a 30-year-old door-to-door sales rep* was executed by Kenneth Bailet Roop, 52, for the crime of “trespassing.”
If true, it will be interesting to watch how the Stand Your Ground doctrine is seen by the courts of FL. My suspicion is the shot to the back of the head puts him in prison for life. Or, Should!
*My bold

In several states there is little protection for homicide outside the home if there is an escape route, such as backing his truck away? Inside, if there are no available safe exits or there are unprotected others in the building who are threatened by the intruder, the rules are far more permissive. Most make a distinction of obvious theft Not being grounds for homicide, with actions that create fear of bodily injury or death adequate justification for deadly force. Stand Your Ground turns all that valuing of human life above property, with some need for examining situations for actual threat before reacting, into blanket justification for execution because of general anxiety??

One point to raise here that seems to have gotten past everyone that is anti gun.

The person arrested shot the victim in the back of the head when he was no longer a threat. In most parts of the country that is called excessive force if not outright murder.

Being anti stupid laws doesnt make me anti gun. I have said in the past I realise people should have guns for defense if they are miles from nowhere.

And now the rest of the story Owner kinda failed to mention in his bullshit diatribe...

quote:

Cape Coral, Florida (News-Press) -- A former prosecutor described him Thursday as a "time bomb" because seven years ago, he pointed a gun at a woman who simply wanted to read his electric meter.

On Wednesday, Kenneth Roop, 52, of Cape Coral, pointed a gun again, police say, and this time fired two shots, telling police he was "in fear." He is charged with second-degree murder in the death of Nick Rainey, 30, who wanted to sell him frozen steaks and lobster.

Now owner, can you explain why you found it necessary to present the story as a Fla Stand Your Ground story when it's obvious that the popo didn't buy Roop's story, and the sorry fuck was arrested and in custody?

Because he CLAIMED Stand Your Ground, which makes it a Stand Your Ground story.

Yes then there is the recent Florida case of the tow truck driver Donald Montanez who shot and killed Glenn Rich, who was trying to get his car back and unarmed, Montanez illegally towed it and was demanding money. Montanez carries two pistols with lazer sights on them and emptied both weapons in Rich, Montanez also carries police hand cuffs. Montanez invoked the Florida Stand Your Ground Law, however during trial it appeared that Montanez was in fact not in any threat from Rich who was recovering his car, in mid trial Montanez then claimed his girlfriend was the one who life was threaten by Rich and he was protecting her, on the stand, the girlfriend stated she was not in any danager from Rich. Montanez was convicted of murder on July 25 of this year, he now faces 25 to life.

The legal right to own firearms is not stupid.

I am licensed to carry a concealed firearm in the state of Texas. and when I travel I exercise that right. I also own six antique cartridge weapons, five black powder cap and ball replica weapons and four modern weapons. I sold a number of weapons to help pay for medical expenses.

The stand your ground laws have problems in the way they are written, since in some cases it allows for the use of deadly force when use of that force is not needed.

In my state, I am allowed to use deadly force only if facing a threat that is clear and immediate, meaning if the person has a weapon I can use deadly force. If the person does not have a weapon, I can only use just enough force to prevent harm to myself or my family.

In other words, if the attacker is using bare hands, I could legally get away with shooting him in the knee cap to prevent him from attacking me, but that means that I can face civil action.

By the way, in Texas you can defend property with deadly force but the person you are defending it from must be in the residence.

I want a mechanism in place to have time bombs' guns taken away. Instead:

According to the report, Roop has a concealed weapons permit, a federal weapon possession license and owns approximately 14 weapons.

~ FR ~

It's not a Stand Your Ground story if the law doesn't apply, which obviously it doesn't. Nor is this the kind of world, "the NRA-owned GOP envisions" -- and the mentality of the people who post these kinds of shit claims is beneath contempt.

Why do you think he wasn't charged with felony assault when he pointed the gun at a meter reader?
A conviction there would have prevented him from having a permit.
