I'm a little curious about this case. The story in the news recently about Douglas Kennedy attempting to leave the hospital with his newborn son brings a number of questions to mind. For those who are interested here is a link http://www.politico.com/news/stories/0412/75101.html.

In Summary Douglas Kennedy wanted to take his newborn out in the fresh air. The hospital had an issue with him and nurses confronted him and who accosted whom is up for debate. While I feel he is sort of a jerk, he didn't do anything illegal assuming the mother of this child didn't have a problem with him leaving the hospital with the baby.

Yes, hospitals have policies and whatever - believe me I know, I work for a hospital. However, you are not a prisoner nor is your newborn. At any time you can walk out of a hospital - sure, they want you to sign out "Against Medical Advice" but you can walk out without signing a darn thing anyway. Their liability issues is for their legal team and quite frankly their problem, not yours as a patient. You very well may be forfeiting some legal options if you (or your newborn in this case) should suffer some ill-effects. As far as I understand this baby was healthy. The nurses, with all good intentions perhaps, confronted him and attempted to pull the baby from him - however, he was in fact the father of this child and therefore, they really had no right to stop him.

What do you think?

I think he should appologize profusely. He is the very epitome of the reason for those policies - because of his last name, his son is 100x more likely to be kidnapped than anyone elses. (because kidnap and kennedy start with the same sounds. Its the law of like attracting like... sorry, bad pun). He should be very grateful that someone, seeing his child leaving with someone they did not recognize, attempting to detain him until security could get there to sort things out. All he every really had to do was wait for security in the first place, instead of making a scene.

I'm not sure they didn't recognize him, I'm pretty sure they knew exactly who he was. I think he was a jerk. The bigger question I think is if its the hospital's right to stop him.

It sounds to me that he is trying to prove a point while putting the health of his son at risk. He probably has the right to do so, but is an IDIOT for doing so.

I think his wife and him should have had a home birth instead of going to the hospital.. then he would not have had the problem in the first place.. Hopefully they will consider doing that in the future if they have more kids... jmo..

His wife said ' he wanted to take a walk with our son '.. He is two days old . She's as dumb as he is. They should both be thanking God (they are Catholics) that something bad didn't happen to their baby.

and yet.. hospitals let parents take their newborns out of the hospital and take them home with them.. they dont charge parents with child endangerment for that.. omg! parents have to walk their new baby to the car!

Your'e right on 3 out of 4..I sold all of my guns a few years ago. I had 8 at one time.

tj, most responsible parents abide by hospital rules before grabbing their baby and taking it outside "for a walk". This baby is just 48 hours old.

Hospital stays for pregnancies with complications averaged 2.9 days, while the average hospital stay for an uncomplicated delivery was 1.9 days.

48 hours is actually rather at the long end for a mother to stay in the hospital after an uncomplicated vaginal delivery these days.

Some hospitals send you home after 6-12 hours.
Unfortunately, tazzy isnt here as that's her specialty.

Now it's been a while since I gave birth, but hospitals don't issue identification bracelets to fathers, just matching ones to mothers and children. Him saying who he was doesn't prove it. If he wanted to take the child out for some fresh air, without the hospital worrying about a newborn being stolen (which is why the security rules exist),  he and his wife should have spoken to a nurse.

Had someone stolen his child, you know damn well he'd be suing them for not having sufficient security.

And I know it was a warm winter but newborns aren't dressed to go outside here in January. He didn't even put a sweater on the baby.
