Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned'
Huffington Post - 2 hours agoTreasury Secretary Tim Geithner, however, is less afraid of wearing that hat. At a Politico Playbook breakfast on May 25th, Geithner was asked by host Mike .../snip

Would anyone like to examine the 14th amendment?

DomKen -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 1:09:30 PM)

That's what the amendment says
quote:

The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.

4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.

Yeah. He ain't talking unconstitutionally.

The current crop of Democrats will do whatever it takes to spend the country into complete and total ruin

mnottertail -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 2:39:20 PM)

The current crop of republicans have them beat hands down at the moment. But why do you attack the messenger?  Why do you derail and type little rushfelcher jingles instead of addressing the topic of the 14th amendment?

Could it be because you can only spew hate and namecall and are unable to use logic, fact and reason to discuss the topics rationally?

Estring -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 2:39:59 PM)

Geithner is another clown bailing out on this joke of an administration.

Is the number of bailee's at 42 yet?

BamaD -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 3:05:14 PM)

That was clearly referring to Civil War debt.

mnottertail -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 3:06:02 PM)

clearly not. or it would have said, Civil War debt.
Civil war debt itself was handled with bills, this is clearly a national direction for the country.

Simple when you have a pen, you write Civil War, and you dont put it in the constitution, you write an appropriations bill if thats what you're after.

Oh shit!!!! Thats what they did about that.

BamaD -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 3:21:29 PM)

What do you think putting down insurrection meant ?   And it says lawfully incurred debt limits are the law.

I do hope you just havent figured out the reply feature yet, because 42 has nothing to do with debt numbers.

BamaD -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 3:29:15 PM)

They are claiming the 14th.

BamaD -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 3:38:40 PM)

The 14th was mainly about holding states responsible to recognize the rights in the Constitution and to insure the rights of former slaves.

And to make the debt the US sold during the War legal, as well as rendering the debt incurred by the CSA void.

BamaD -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 3:51:49 PM)

Exactly the point I was making in my first post but was informed by someone who had not read the 14th that A it wasn't about Civil War debt an B Civil war debt wouldn't be addressed by Constitutional amendment.  I was also informed that the 42 amendment had nothing to do with debt.  Don't know how they knew since there are only 27.

Termyn8or -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 6:30:52 PM)

"authorized by law" is pretty clear. That means any debt they authorize, ain't that kinda what raising the debt cieling is all about after all ?

Also, the wording of other parts of the 14th does happen to state that southerners had no rights, because they had participated in a rebellion. And not to mention that people who actually declare themselves not subhect to jurisdiction are therefore not entitled to equal protection under the law. Technically that takes care of the right to alter or abolish it, and forces compliance of those in the government.

Most people will have to read the whole thing about fifteen times to figure this out. It may not be construed that way, but it could.

T^T

termy8tr  my point exactly

BamaD -> RE: Tim Geithner: 14th Amendment Says Debt 'Shall Not Be Questioned' Huffington Post - 2 hours ago Treas (6/30/2011 7:04:13 PM)

Nothing in there makes debt ceilings unconstitutional.

Then explain why they defaulted on it.
