Supporters of California's Proposition 8 say that the legal decision to halt implementing Prop. 8 be itself overruled because the judge (Vaughn Walker) is gay, and therefore couldn't judge fairly.

If this argument is legally valid, should no black judge (such as Supreme Court Justice Clarence Thomas) be allowed to rule on a legal case involving black people? Being black, the judge obviously can't be impartial, right?

If this argument is legally valid, should no judge who is a Roman Catholic be allowed to rule on a divorce case, since their church teaches that divorce is wrong?

If this argument is legally valid, should no judge who is vanilla be allowed to rule on any legal case involving kinky people?

If Judge Walker is overruled simply because he himself is gay, what are the extended potential legal complications?

Thats like saying a white judge shouldn't rule on cases involving white people. Or the female judges cant rule on abortion cases. Its utterly ridiculous.

Clarence Thomas might not be the best poster-child for this, given his known issues with failing to disclose significant and material amounts of family income from people with business before his court.

But the point is to be considered. Should the female members of the court recuse themselves from reproductive freedom cases because they have vaginas?

Then the supporters of prop 8 should take it up the ladder and keep their mouth shut about judicial bias. It's a good way not to be heard by the higher court.
   You don't mention on which level of the court Walker is seated. Is he on the state supreme court (and therefore ruling along with a panel of judges), or is he a US District Court Judge (Ruling solo)?

Well, only if you try to disqualify Thomas on the basis of his being black. We can no more call him biased towards blacks than we can Anton Scalia biased towards Italians. If it's a case to do with basically ANYTHING to do with business, well then the fact that he's a crooked piece of shit can be argued as grounds for recusal.

Speaking of Scalia... he's recently refused to recuse himself from a case involving Dick 'Why don't you go Fuck Yourself' Cheney. And the mother fucker goes duck hunting with him

Long and short is the OP shouldn't get his hopes up... I mean IF that is what he intended.

A black bias would only apply if the case were black vs white. Then, carrying the argument through to its absurdity, both black and white judges should recluse themselves. Hmmm... We need Obama on the Supreme Court ASAP... Have we ever had an ex-president on the Supreme Court? Could he appoint himself? Hey, I'm just saying...
