Supporters of California's Proposition 8 say that the legal decision to halt implementing Prop. 8 be itself overruled because the judge (Vaughn Walker) is gay, and therefore couldn't judge fairly. If this argument is legally valid, should no black judge (such as Supreme Court Justice Clarence Thomas) be allowed to rule on a legal case involving black people? Being black, the judge obviously can't be impartial, right? If this argument is legally valid, should no judge who is a Roman Catholic be allowed to rule on a divorce case, since their church teaches that divorce is wrong? If this argument is legally valid, should no judge who is vanilla be allowed to rule on any legal case involving kinky people? If Judge Walker is overruled simply because he himself is gay, what are the extended potential legal complications?
