I'm sure we're all familiar with this nugget:

As far as I know, it's complete and utter bull. It sounds all fancy-pants, but let's be honest:
1. The Internet is a public place. Just like people can legally film and photograph* you when you're walking the streets or even driving in your car, it would be a drunken judge indeed that decided the Internet was private. Hell, even on CM, people who aren't members can browse profiles and read info. Signing up is easy and anonymous, and I don't believe the site is in any way "private", with the possible exception of the cmail you can send and receive.

2. Ready? You are now all PROHIBITED from using any information in this post to reply to me. This post is COPYRIGHTED, and if you use any of the information or data in this post EVER IN YOUR LIFE, I will SUE YOU. See kids? Any time you say something is copyrighted, it instantly has magical powers!

3. "All material posted under this profile and its 'linked' pages is protected by COPYRIGHT of the owner/poster." That's right, this person just magically COPYRIGHTED the entire Internet. Because from a site this size, literally any webpage in the world will be linked. Let me show you:

Your 'legally protected' profile > Message boards > Political and Religious Discussion > Topic that links to a news site > News site has a linked search tool > Search for Google > Go to Google > Any webpage on the Internet.

4. What if I'm not using this site for a study or project? What if I'm just a total douche that is going to publish all of your personal information in a newspaper? What if my study is on "percentage of people who think a bullshit protection clause keeps their information protected?"

5. Why the fuck do you care? So what if somewhere a student notes that your profile makes the term "spermdumpster" the most commonly used phrase on the Internet? It's not like you're harboring project gold that must be gathered to make the shiniest project of them all.

6. Nobody gives that much of a damn about your profile. Get over yourself.

7. Once again, I'm 99.8% sure that this clause offers no legal protection of any kind whatsoever.


Goodness. Well, I think that about sums up my rant. Any thoughts? Comments? Just go ahead and agree with me on every count. We all know I'm right.


(*In California, if you are a student or have a permit, you can legally film or photograph anybody in public. Granted, you may be asked to leave privately owned property, such as a store.)

Thank you so much for your post, I get quite a kick out of those notices and disclaimers, I am so bad that I even sometimes think about saving their pics to my HD in case I need some kinky stuff, but I would never ever actually do that

LOL...yeah...I agree it's funny...really it is, but there's a reason for it.....sorry yeah, being serious a sec...it happens occasionally...

The problem that you have is if you want to PUBLISH the paper, dissertation, etc, you may need consent to use other people's personal information. However, in the anonymous regard, I'm not really sure how well that goes or how much it applies. Anyone getting their masters or phd will find there are ethical considerations to their dissertation that have to be followed to have it approved and in some places that includes using ANY information and certainly likenesses (pics, film)...that's the reason for the requests....

then again many of my friends completely fabricated the research for their masters.....

I forgive your seriousness, and raise you a quoted reply.

I am but a lowly freshman in college, and as such I am not aware of the ethicalities (or, ethical technicalities) going in to projects, especially those regarding information that comes from the Internet. But here would be my take:

1. It is an extremely public site (note the OP).
2. As long as personal information is not given out (which I see no reason for lists upon lists of people's birth names and phone numbers to be attached to a project or study of any kind), nobody's privacy is being violated.

Yeah I agree, I'm just pointing out that's why they ask, and I was required to come up with consent forms to submit my research....not sure how they'd get around that, print out the email I guess.

Not I, friends. I was fortunate enough to have a job doing the thing my research was on..so it was easy. By the way, we have TONS of educated kinksters here.

I once saw a profile which had pictures that were all taken off the Internet.  And the profilee actually had that disclaimer covering pics that were not even hers!

Part of the problem is that people still seem to think that by mailing themselves something they have written constitutes a legal copywrite. It doesn't.

As for the statement including "linked pages" which would include this forum, they have no such right. The forum is for all intents and purposes "public" and by posting here, anything you post has no such protection.

But it is much simpler to allow people to continue to think that their words are so prophetic that they need protection and then just laugh at them when they aren't looking.

I don't agree, nor do I think education makes a person necessarily the smartest. There are a hell of a lot of people on these forums that make me feel stupid by comparison. I don't really know what the comment was about...but that's not coming from me.

If you're saying what I think you're saying, it's just not true. You don't need to mail yourself something in order to establish copyright; you've already established copyright simply by writing it. It doesn't matter whether you post it publicly - if you wrote it, you own it. That doesn't mean it can't be quoted, or even copied to an extent under the "fair use" provision of copyright law, but profiles and your pictures are protected by copyright law.

I think most profiles read like small ads for lost dogs anyway. There are people with a fetish for making all their posts or communications look like a proposed thesis. Undergrads always amuse me, they assume that you have never met anything like them before, that no other intake of hormone soaked drunks has ever produced such priceleass paragons of wit and genuine intelligence.
