Status: offline 		In converation with a friend the other day - we commented about how all of hte bdsm porn seems to come out of California, at least when the porn is made in the USA.
He stated that "well california is the only state where paying performers for sex is not illegal".

I asked why doesn't Nevada permit porns to be made. It has legal prostitution everywhere but Las Vegas right? What would be the difference? between making a porn and being paid for sex versus just paying for sex? The obvious is something to do with filming...


Anyone want to shed some light on this?

Aside from being legal to hire performers there, the Valley is an adjunct to "Hollywood" so there's a never ending supply of fresh young faces looking to get their foot in the door of the industry. Not just actors and actresses, mind you, but lighting, sound, set construction, editors...

Now, with the economic downturn, I can only imagine the kind of quality talent that might be available there, just trying to earn a living until things pick up again.

Status: offline 		Hmmmm I think your friend needs to look up the laws. It is not Legal to Pay someone for Sex in California. In Fact they have many laws that put prostitutes in jail and roads paved with the fines their pimps pay to get them out.

In Fact if I remember correctly, it is illegal to FILM Pornography for the purpose of sale.... However you must be caught in the act and there has to be a warrant in place before the cops can raid meaning they have to know for certain that Pornography will be filmed at the time the kick the door in... This is why it is rarely done.

So Why California?

California has THOUSANDS of Production Companies and DVD and Film Processing Companies and even more Actresses wiling to make a buck from a fuck.

It is because all the things needed for porn are all right there.

Flordia WOULD be a good place but that have very strict Decency laws.

Where is STEPHANN When you need him he knows all about this.

But the entertainment industry is based in LA. It just is. If you live here, you get to see places you know standing in for far away cities all the time.

...and porn is shot in florida too.

while it might not be good for an actor or actress's resume if they want to make the move to mainstream productions someday, this slave has met photographers/technical folks that started their mainstream careers working at shooting porn.  they said that it was the worst working conditions a person in their line of work could imagine...so if one could successfully do their job under those conditions, it would look good on a future resume with a mainstream production company and was excellent experience.  sort of like participating on a "Survivor" episode.
 
they also said it was a great way to network.
 
as for why the San Fernando Valley?  California, especially Southern California has a long history being a backdrop for movies and is thick with production companies, suppliers, actresses, actors, directors, schools where movie-making is taught, etc.
 
Did you know that the set from Cecil B. DeMille's non-porn of 1923, Ten Commandments (the length of two football fields) is STILL buried, 6 feet deep in the Oceano Dunes?

The best porn is shot and stored only on memory, and seen/felt only live by the viewer, unless of course you fuck about showing off for a camera, which is fine if  you like that and that gets your kick (without $$$). Obsession (amongst heathens, obviously ) with paying for sex, "capturing" porn/sex, rules on who can do what to who,when and whyfor and under what contract is killing the concept of a genuine "relationship" which in turn is giving porno rob dogs a chance to cash in on the "free market"  created by the government ... "free" NOT  being a popular idea these days in "the land of the free" and shit like that, is a term open to "interpretation".

If you get served a crap steak you want your money back, if you pay for porn or sex... (you know where this is going ...) and its crap , do you behave in the same way if you don't "get off on it"?

If the US has such different rules from state to state, then it is not ONE country ... Simple.

It's just where the industry started to grow big.


Economy

The Valley became the pioneering region for producing adult films in the 1970s and since then has been home to a multi-billion dollar pornography industry earning the monikers "Porn Valley", "San Pornando Valley" or "Silicone Valley" (a play on Silicon Valley and silicone breast implants).

The leading trade paper for that field (AVN Magazine) is based in the Northwest Valley, as are a majority of the nation's adult video and magazine distributors.

According to the HBO series Porn Valley, nearly 90% of all legally distributed pornographic films made in the United States are either filmed in or produced by studios based in the San Fernando Valley.

As far as the legality, it stems from several Supreme Court decisions regarding obscenity as opposed to First Amendment rights.

My understanding of it is that performing sex on camera is not in itself illegal.  It is considered free speech as opposed to prostitution, but may be considered obscenity and the performer can be prosecuted under those laws.

Of course there are qualifiers to that, based on several murky decisions of the Court that try to define what obscenity is.

The prevailing decision is Miller vs. California, which basically leaves it to each locality to determine what is obscene based on the vague notion of "community standards":

if your production company is based in the San Fernando Valley, why pay for all the equipment and the staff to make the trek to Nevada to shoot?
 
Besides, Clark county(which includes Las Vegas) is pretty strict about what goes on there...they don't allow for prostitution and state regulators are pretty picky about what they will allow.
 
For example, in 2004, the Hard Rock hotel-casino paid a $100,000 state fine related to a provocative advertising campaign.

Status: offline 		...as far as porn in NV goes, I am not familiar the industry in that state. However, I think perhaps it has just been your exposure and or the distribution deals in your area that give you the impression CA produces the majority of BDSM porn. When I lived in Detroit, it was distribution deals that made me think Chicago & NYC were the porn center of the BDSM world.

Porn comes from everywhere in the states, although the film industry is larger in CA. Proportionately the quantity of BDSM porn is in scale with it. New York has always been a major source of adult BDSM films and niche porn for a long time. Several of the largest porn production companies in the world are based in Florida, in and around the Miami/Ft Lauderdale areas.

My personal bias for BDSM porn has always been for eastcoast productions. They seems to have a raw edge compared to the westcoast stuff.

Hm. Kink.com is situated in a landmark building in San Francisco, and the dates and times of their live streamed shoots are advertised on their website. It seems as though that would be pretty strong grounds for a warrant to be issued if this were the case

The OP raises something i've wondered about for a while, though- it seems as though one should be able to run a legal house of prostitution simply by treating it as a private pornography studio... but obviously there's a catch somewhere?

He made the real deal BDSM videos not the Crap that the major distributers made.

He explained it briefly to me but he was always rather secretive about his exact filming and sexual selection process.

Honestly like I said I am not exactly sure about the above statements but that was my understanding and it made perfect sense at the time.
