I've read Mr. Wiseman's article on this issue a number of times since it is widely quoted. Lots of excellent information there except for this part:

"The authorities could consider such deaths first-degree murders until proven otherwise, with the burden of such proof being on the defendant."

Mr Wiseman may have considerable background when it comes to the medical, anatomical and physiological intricacies of breath play but his background in law isn't quite what it could be. Even someone with only a passing interest in the trial law knows that the burden is always on the state to prove its case - not the other way around.

Well there you go: yet another case of the gulf between de juro and de facto.
It would be very difficult to convince a jury it was consensual expecially when you've lost your voice after a good session though.

Status: offline 		I think if someone is dumb enough to do breath play with someone who's only training was a quick 101 run through online, and dumb enough not to verify that the choker knows what they're doing well then they're getting their just desserts.

I will agree with what others have said about having such a topic and understanding that some goof...who has no experience...will read what others have posted on a board and...tonight try...it.
 
However...CM has allowed us for the most part..to be able to post on many areas within the realm of the BDSM world...I appreciate that...
 
I had to be taught a few different ways and being taught...I was the victim...for lack of better word...Do I need to share them here?
