The Texas Supreme Court has ruled that a church can kidnap, restrain and abuse a person as long as it is part of their beliefs.

Texas is looking more attractive everyday.  Now to finish getting my church up and running.

While I enjoy your over the top declaration, the court did not rule what you are claiming.  I would also point out, that if the charges were accurate, why didn't she pursue criminal channels against the individuals that committed the "crimes".  It couldn't be that she was rebelling against the church, because she didn't want to follow in the footsteps of her parents and become a missionary?  Or to otherwise discredit the church itself?  Nah... the church is to blame, not the individuals.

On the surface, it does indeed look like one fucked up situation. But, as Thadius mentioned, there could be "extenuating" circumstances.

Actually, as a Texan this doesnt surprise me at all. They take this whole religion / demonic posession / exorcism thing seriously....

As for your comment about "cults" owner... There is no room for more cults in Texas. We already have the Baptists and the Pentecostals on every corner LOL

It looked like the Texas court focused very narrowly on the actual physical contact in the religious practice called 'laying on of hands', and decided that while it could be battery outside of its religious context, they weren't going to get into the business of setting church doctrine. 

My guess would be that they want someone in a courtroom a little more to the north and east to make that ruling...[;)]

Or just Northwest, in the 9th (hmmm, I think that is the court in San Fran).

The link provided, seemed to only be focused on the civil lawsuit (unless I read it wrong).  For me it just seemed like this would be the same as suing one of the rehab institutions for the intervention carried out by friends and family.

I've now read the majority opinion and it appears the justices draw a distinction as to whether the target of the exorcism is or isn't a member of the church performing the exorcism.

Still a truly bizzare distinction to draw. It's constitutionally protected behavior if done to a member of the church, even if it isn't consensual, but doing it to a non member isn't allowed.

Just guessing here, but I would venture they "protect" the church doing it, while non-consenual, because the church sees it as a way of "fixing" someone not in their right mind.

I have several questions and not enough time to do a thorough background search on this report.  (being careful of the wording due to TOS)
 
#1 The age of the plaintiff.
#2 Parental presence or permission
#3 Membership or non membership in the the church
#4 Medical treatment provided to the plaintiff following the injuries?
#5 Psychiatric treatment provided to the plaintiff following the abuse?
#6 Consent to an exorcism? (Legal precedent)

PS - Level, unfortunately this type of situation still happens.  It happened to a young lady who was a friend of mine.  And the relatives I avoid like the plague?  This is their type of religious behavior.

Texas has a terrible record on certain issues. It's not someplace I think I'd be inclined to move to.

OTOH, AFAIK, Texas prohibits the use of Peyote in valid religious ceremonies by Native Americans. By upholding the practices of a white religious sect and denying the practices of a First nations religious sect, the State of Texas is affording special treatment to one particular religion, which is Unconstitutional.

Vendaval, then I would avoid them too; I'm a Christian and glad of it, but let's just say that many of my brethren and I don't see things the same on a number of subjects.

I lived there 10 years and change. My stepfather is 3rd gen Houstonian. My bro-in-law's father outfitted the Houston Oilers when Bud Adams first got the franchise. His bro is (or was around 2000) Asst. DA for Houston. They went to private school with the Shrub boys. Buddy of mine managed Rockefeller's for years. I played in a "Punkabilly" band, other bands would go set up then come hear us.

Lots of cool stuff about Texas. Lots of weird shit, too. Plenty of swaggering assholes - "all hat, no cattle".

SXSW in Austin every year is absolutely cool.

South Padre Island is great.

Good mornig! Yep Im back...  Seriously though when it comes to religion and Texas nothing surprises me. We have churches down here the size of malls. You aint seen nothing till you have seen a herd of Pentecostals in a frenzy.

I shit you not, they speak in tongues, they convulse, they "testify" meaning they confess / blurt out the weirdest shit like "I let mah husband put it up mah butt!" Then the whole church forgives her. Whe looking at religious rulings in Texas ya have to realize the judge probably goes to a church where they pass around live rattlesnakes LOL
