There will be a brief pause between the introduction and the story climax. If you choose to respond to this let me know what you expected to happen next before reading what did.

Seriously though the jury's verdict speaks to a very weird mindset of the "typical" citizen.

It seems rather clear that this country is slowly moving towards a fascist police-state. But I've no doubt that some of the people here at CM see this as a good thing.

If the law says you can't expose your penis in public, then you can't expose your penis in public.

Having said that, I watched the video on the link you attached.  Talk about entrapment.  And exposure?  Where was the exposure?  Did he just unzip his pants?  It looked like a private exposure if you ask me.  No one around for miles... The conviction is ludicrous. 

Then again, this brings up an issue you didn't mention in the OP.  If the man's appeal is successful, what does that mean for rapists who claim they were enticed by seductive behavior?  This creates a fine line between self control and the inability to have self control. 

Then again, looking at the video...just looks like two willing participants making a connection of sorts.  What a shame.

Yeah, this is complete nonsense.  I understand them trying to keep weirdos out of the park.  I would be all for a sting like this on pedophiles and the like.  But this guy didn't do anything wrong. 

He's walking through the park, and he sees a topless woman.  He thinks to himself, what the hell?  He walks over and introduces himself.  The woman flirts with him, touching him provocatively on the shoulder with her leg.  I would see that as a come on.  Then she asks to see his penis.  This guy thinks, "Damn this is my lucky fucking day!"  He looks around and shyly shows her what he's working with.  I admit, it's not the most clever thing to do.  I wouldn't take mine out in a public park.  But I can't blame the guy for thinking he hit the jackpot.  This is completely ridiculous.  I guess the Columbus P.D. doesn't have anything better to do, because Columbus just doesn't have any serious criminals running around.

They say ignorance of the law is no excuse, that being said i think what happened to this man is disgusting and the police have wayyyyyyyy to much free time on their hands.  i am all for getting perverts off the streets and away from parks but i don't see this man as either.

I'm not down with the entrapment tactic at all.  I think the cops should be making better use of their time.  And I think it's arguably wrong to entice someone then to bust them.  Maybe there should be some crackdown on that shit. But the fact remains if you're not breaking a law, you can't be entrapped doing anything wrong. 

I wasn't able to play the video, but I read the article and I think the jury made the right decision; I think they made the only decision they could make. If it's illegal to take your dick out in public, it's illegal to take your dick out in public. The fact that a girl was exposing her breasts (whether legally or not/police personnel or not) flirting with him, and asked to see his dick doesn't exonnerate him from the responsibility of making a prudent judgement call.  He could have chatted with her and invited her to his apartment as an alternative, instead of entertaining her advances and taking his dick out or fondling himself.

As far as signs being posted on what body parts are legal to expose and what body parts are not, well, it's everyone's responsibility to know the law.  "I didn't know" isn't a legal defense. There are no signs around saying: "Don't buy cocaine on this street corner" either.  It's a pretty safe bet that exposing or fondling your genitalia in a public park is going to be illegal.  I mean, it was a pretty sucky break for the guy, but he did something pretty stupid too.  I'm not standing on high ground or saying I've never done anything wrong, but you gotta know that if you break the law, whether it's a misdemeanor or a felony or whathaveyou that you run the risk of being busted for it.

Well if he had kept it zipped up and went on about his business he wouldn't have gotten into trouble. Perhaps there is a lesson in this..if you see a woman running around in public with her tits hanging out and she askes to see your cock, walk away from her....

    I think police actions are totally wrong.
    Dont they do the same with regard to drugs ?
    I should have thought there might have been  a defence around what actually constitutes exposure.

    The scene reminds me of the joke, Monty Python maybe, where a bloke is up a tree like an escaped bird and is enticed down by a sexy female.

    ghita I had hoped you were kidding, but a quick peek at your profile reveals that you are in FL.

    I have been to FL and had a great time there but I would never move there. It is hard to explain why, it is a mixture of the attitude of the government there, and the people. "passed a law making it a crime to........". If it's a crime it has always been a crime.

    I also remember FL being the state in which a bunch of old Men got busted for gambling. Their crime ? Playing pinochle for a penny a point.

    Don't feel bad living in a police state, I do as well. Ohio has so many shit stains on it's Constitution that F. Lee Baily will not set foot in this state.

    So the charge is that he offered ten cents for something completely undescribed. I tell you what, if he can't beat this it is for one of two reasons, one would be that we are all in vwery deep shit, or he needs a new lawyer. I can't see him eating this if your account of it is true and complete.

    And the other problem in FL is the religous fanatics. That means you can't trust a jury.

    And if you can't trust a jury, you can't trust anyone.

    Thing is, they really think she was going to hop in the car and polish his knob for ten cents ? Some solicitation. But then in FL who knows.
