Synopsis
On March 21, 2007, attorneys at the Center for Constitutional Rights (CCR) added new plaintiffs and new defendants to a lawsuit seeking damages and declaratory relief for five released Guantánamo detainees who spent years in captivity under abusive conditions at the offshore prison camp. The suit is brought against former Defense Secretary Donald Rumsfeld, former Chairman of the Joint Chiefs of Staff Richard Myers, and dozens of others, including civilian and military personnel at Guantánamo. It charges that the Pentagon chain of command authorized and condoned torture and other mistreatment in violation of the Alien Tort Statute, the Vienna Convention, the U.S. Constitution, the Religious Freedom Restoration Act, and the Federal Civil Rights Act. None of the former detainees has ever been a member of any terrorist group, and all were released without being charged with any crime. The suit was filed in the United States District Court for the District of Columbia. See the Cuba/America Treaty?

See the US Jurisdiction in Gitmo.

Go read the 14th Amendment, see where the word Jurisdiction shows up.

Geneva's got nothing to do with it. IF it's the US Government doing it, then it must be Constitutional. If it's not Constitutional, the US Government has NO BUSINESS DOING IT.

So, show me in the Constitution where The People have delegated the authority to run torture camps?

What do those savages have to do with the American flag besides the fact that they're probably wiped their asses with it?

The American Flag denotes American Jurisdiction. THAT means that all the limits placed upon the Government by The People are in play.

Keep that in mind. LAWFULLY, the only things the Feds can do, is what we EXPLICITLY told them they can do.

Since we've never told them they can deprive Equal Protection and Due Process, then they cannot.

The US Flag does not necessarily denote jurisdiction.   It doesn't even necessarily denote the presence of Americans.

On 9/11 there were how many American Flags flown then burned in the Arab World?   If Jurisdiction was indicated then we were totally justified in going back and taking over the entire mid-east (preferably one country at a time) because they fall under our jurisdiction.

When I was in Holland, both years, we flew the American Flag.   It was flown on the left of the Dutch flag at all times.   It was their jurisdiction (It was only ours when the 82nd Airborne made it ours in 1944).

The detainees are not enemy soldiers.   They are not POWs.   Spys   possibly   Could they be shot, probably.   Are they covered under international treaty no.

The 14th Amendment does not apply to everyone.   If it did, we would have way many more states and territories than we do now.

Go read the article. These are people unlawfully held for years WHO HAVE BEEN RELEASED FROM GITMO.

Ultimately, though, I think the real question Gitmo raises is not what kind of people the detainees are.

It's what kind of people we are.

I wanna know from YOU, how YOU justify throwing someone in jail for 4 years without trial or charges ruining their life. I wanna know how YOU would feel if it happened to you. Would YOU just forgive them and start to rebuild ? I think not. I think you would go running for those exact same lawyers.

I would want every last dollar I could scrape out of it, I would want the greediest lawyers I could find, working on a percentage of course. But the thing is, I admit it.

Everyone is entitled to their opinion, that is agreed. But there are those times when one must justify or explain those opinions, and I believe this is one of those times.

I can justify and explain my opinions on this matter, can you ?
