pahunkboy -> Tractor Trailer, totalled my car/ !!! (2/28/2007 5:07:07 AM)

Yesderday- I headed out for a latte, very close to house. I had the free coupon.

/out of nowhere- smashh. the dude was mad at me.  police/ambulance/extracation/ER

here I am no car. I dont know PA traffic law- tho it is a "no fault state."

It certainly did not help my existing injury.

Does anyone know PA law?

My insurance is Liberty Mutual.
I did not have collission.

Truckdrivers  are rather unprofessional these days. This cant happen now! But it did. I am looking for the local paper. Scanner listening is big here.

I did not have collision.

Please reply- per advice.  I made a few calls to see if I can get folks to offer rides. we have no bus here.  The cab company hours are 9-5????

When is it a convenient time to have a car acccident? lol.

As a rule I dislike insurance companies.

In any event- anyones experience/knoldge- the good the bad the ugly. on board or off.
Thanks all!

well if he hit you and you did nothing wrong yourself he is at fault as long as there is fault, ie no bad turn, sun in the eyes, that sort of thing.  Call the insurance company and make sure they get a copy of the police report.  Roommate's room was just in an accident right after the ice storm, she hit the guy but it was determined that no one was at fault due to road defect (city still had ice on the roads 3 days later) and it's a bad curve.  Sorry about the ride situation do you have rental on your insurance or a buddy that you can car pool with?

Who was extracated?  You or the other driver?
All you can do is file a claim, the insurance company will take care of everything else.  Do not talk to the other driver or insurance company during this time period.
Sometimes these things can take months to get sorted out, with the insurance companies going to arbitration (been there; done that).

BOUNTYHUNTER -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 6:26:12 AM)

IF you are smart din't consider "settling" for at least 4 months,I had an accident about 6 years ago settled in 3 months only to develope major back problem from the wreck a year latter.I have decided even in a fender bender ,I"LL give it a while before thinging about a settlement...Good luck..bounty

pahunkboy -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 6:37:23 AM)

Bounty and Katy;  i have all the time in the world [to settle]

correction book value $4270.

I was extracted, not teh trucker.  Katy you know PA law. I never understood it.  Being that you also live in PA, you know more then I per driver laws.  [very dif then Illinois, where I grew up]

KatyLied -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 6:49:50 AM)

Actually I don't know a lot, just the common sense stuff.  Communicate only to your insurance company, forward anything from the other driver's insurance company to your insurance company.  And an accident report will not always save you.  I was in an accident where the other driver accepted responsibility, it was written into the report, a few weeks later she recanted saying she "bumped her head and didn't remember taking responsibility."  The police took it to the magistrate, the insurance companies went into arbitration.  My car was repaired immediately, but it took months in arbitration before everything was sorted out.

sub4hire -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 7:38:06 AM)

Listen to Katy's advice.  Don't talk to anyone about settling about anything until you know you are ok.  Try to determine if you are going to have any future issues.

A friend of mine had 3 kids in an accident last year here in Nebraska.  Guy ran a red light...almost took out all three kids as well.  One came out unharmed.  One had a broken nose and a few broken bones.  The other child got to spend the next three weeks in ICU with a broken back.
He had just recently gotten to the point he can remove his back brace to walk.

The insurance wanted to settle before she even knew if he was going to live or die.

subfever -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 11:08:54 AM)

I don't know PA law, but according to my understanding: if you don't have collision on your insurance, damages for your car will be covered by the other driver's insurance... up to the percentage of his/her liability.

Geez... there never seems to be a dull moment in your life! Glad you haven't sustained any injuries.

Is there a cheap, but reliable beater you can pick up for a few hundred bucks, and drive until your claim is settled?

pahunkboy -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 11:14:32 AM)

Got it Sub and Katy.

In regard to me, myself and I; I AM SICK OF ME!

The car is a most likely a total.  I finally got a church person to take me to a decent dr.  A new one- I like his bedside manner. I was frank, direct and thorugh with him.  I have been wanting to switch drs anyway. Funny thing- I run into conacts via the net. A dude on freecyle reccommended this dr!!

My friend Jims friend is selling her pickup- good price- I want it. She had it sold but the buyer  cant produce cash,...

Frankly I am over whelmed with everything all at once.  Trying to get a mortgage, move, now no car- yada yada- in short , I am sick of me.

subfever -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 11:32:50 AM)

The last thing you want to do now is beat yourself up over things that are not your fault or within your control. Keep your chin up. Take things slow, and one day at a time. Everything will work out fine.

My insurance is no rental if my car is totalled, which completely sucks.  But i do get rental if the car is being repaired.[:o]

I'm sorry this happened and would suggest you get checked out by a doc and don't sign off with the insurance co. for injuries for many months in case something pops up.

Quivver -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 5:05:51 PM)

I dont know PA law, but assuming it's not too different then VA here's what I just did.
Do not sign or settle anything related to personal injury.
If they make you an honest offer on the wheels take it, it wont effect the injury claim.
If you feel what they offer on the car is too low, they can and do adjust if you can prove your findings.  They should offer you a rental to drive.
Go to all your doctors apointments!
Follow up and make sure your well.
Get an Attorney.  If you do not have medical insurance the Attorney will be your insurance policy with medical providers.  Last but not least... be patient, it's gonna take a while to get it all done with.  Mine was almost a year ago......... Grrrr still not done!

pahunkboy -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 6:16:47 PM)

let me ask this- I am the umteeth person to wreck there- turning into the store.   I requested security camera tape- as Im prettty sure it was caught on tape.  They said only the police can do that.  --I dont think they will furnish what  they have.  The poor design of the store  = many wrecks.

The store is partially negligent.   who knows

MasterG333 -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 6:31:46 PM)

I used to drive tractor-trailer. MOST are very safe drivers. your opinion that truck drivers these days are not professional simply is not true. Truck drivers average 1oo,ooo miles a year and if they are not safe,they simply do not last. There are,of course,newbies,or just plain bad drivers,but they are in the extreme minority. Good luck. BTW: you say it was his fault and the store's fault. you were 100% innocent?

Quivver -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 6:49:00 PM)

How's it the stores fault?  Did I miss something here?

MstrDouglas -> RE: Tractor Trailer, totalled my car/ !!! (2/28/2007 7:07:10 PM)

Be glad you arent from MI, here the insurance companies say you are automatically 50% at fault for putting your car on the road.  Also we have the "no-fault: insurance law here, and if you dont have collision on your vehicle.....it is up to you to TRY to get money from the other company.  The whole idea behind "no-fault" was supposed to be making it easier to get your vehicle fixed, until the lobbyest got to work on the law.  Good luck, hope it all works out for you.
