Hey all. My dear friend, whom I will refer to as knucklehead- is soon evicted. I myself have been on both sides of the process- tho- that was many years ago. My "friend", cleary sees he can not negotiate with the new landlord. He needs to stall an eviction so as to set up the next place to live. Basically the new owner is shooting himself in the foot...via his greed- and bait and switch. Laws vary from state to state and change. Picking the brains of CM members.... help. If all goes well knucklehead will have a riverfront view. If not, knucklehead will be in a homeless shelter/skid row. On or off the board. -please help. [experiences on either end, tactics, how to stay out of jail, and how to preserve funds needed for next home]

If your friend becomes homeless, doesn't that immediately put him at the top of the list for section 8? I know that many years ago (in Illinois) that happened. Women in unfortunate circumstances (with abusive husband/boyfriends), would apply for section 8 then become "homeless" and get moved up on the waiting list. These were women w/children and they had to go to shelters, be declared homeless then they could get the next section 8 opening. Not sure how this works with men.

Unfortunately for him, the storage locker was in Needles, California, on the border with Nevada. I owned a 3 unit in Chicago- in the 80s. I did 6 evictions. Never went to court. So I was proficient. The final tenant- was a buddy of teh guy i evicted. as revenge- my place was torched. it partially burned. long story short- i walked away with my life and thats about it. teh neighborhood went to the gangs. today= 20 years later- they are building 300k townhouses on that block. go figure.

I had a landlord who spent all of his time using power I paid for to run a shop out of the garage of the place I was renting. When I complained, he pointed out that legally he could come in and put all my stuff in storage without getting a court order first. People in California think Colorado has stupid laws in favor of the landlord. Took me 9 months and 15 thousand dollars to get rid of somebody here. The laws are not the problem. No matter how you write the laws, some subset of people will insist on trying to screw other people. Sinergy

The west coast is tough....and I'd definitely say it leans towards those renting. Most folks really have no idea how long they can stay just by manipulating your situation a little. I've personally dealt with a situation very similar to the one Sinergy has mentioned, only mine lasted six months instead of nine. If you're in the business of renting houses.....it's just the cost of doing business.[;)] - R

Sinergy We have the same types of problems here in NY. Recently got a call from an upstairs tenant who informs me that the downstairs couple are breaking up the house. ( we had started eviction process against them for non-payment of rent 3 months arrears) and I visit the local PD. They inform me that the tenant has the "right" to break the door and put holes in the walls as they have a securtity deposit. They will not arrest them. As they already have a $2000 + debt I will never see the money for damage. I'm going to have to remember that shipping the tenants crap nearly out of state for my next evictee. It really irked me that we have to pay the first months storage for deadbeats.
