But US district judge Jeffrey Bryan deferred until future proceedings the question of whether Lindell – one of the country’s most prominent propagators of false claims that the 2020 election was a fraud – acted with the “actual malice” that Smartmatic still needs to prove to collect any damages.

The judge said there are “genuine fact disputes” as to whether Lindell’s statements were made “with knowledge that they were false or made with reckless disregard to their falsity”. He noted that the defense says Lindell has an “unwavering belief” that his statements were truthful.

The judge ruled there were 51 specific times when Lindell falsely claimed – in documentaries he produced and through various media and personal appearances – that Smartmatic interfered with the results.

“The court concludes that, based on the record presented, no reasonable trier of fact could find that any of the statements at issue are true,” Bryan wrote.

Smartmatic attorney Erik Connolly said they will be seeking “nine-figure damages” from Lindell and MyPillow for “spreading lies” about the company.

Nine figures? Thats 100s millions. I did wonder what happed to that raving crack addict. That isnt the dominion lawsuit either, and that one I think Fox-shit settled for $1 billion or thereabouts which is 10 figure's, and trump is suing everyone now for 11 figures.

Lindell's legal firm said in an October 2023 court filing that Lindell was in arrears by millions of dollars in fees and that the firm could no longer afford to represent him. Lindell praised his attorneys for their work, adding, "We've lost everything, every dime. All of it is gone."

Liz Oyer, a lawyer with the United States Department of Justice handling pardons for a long time, was fired by the Trump administration in March. Since then, Oyer has publicly criticised the administration, including its approach to pardons.

In an April 30 video on TikTok, Oyer took issue with many of Trump’s pardons, not only because they short-circuited the justice system but also because of their financial impact.

US Senator Cory Booker, a Democrat from New Jersey, shared her post on May 31 on Instagram, saying Trump is “selling pardons to criminals who dump money on him and ingratiate themselves to his ego. They not only get out of jail, but they get out of the money they owe to make restitution for their crimes. This is wrong.”

Oyer’s Substack includes a running list of Trump’s pardons, along with a dollar figure for each that she says the pardon erased. The dollar figures on her list include fines – a financial penalty for being convicted of a crime – and restitution, which is designed to compensate victims for their losses.

the vast majority of clemency actions by Trump’s predecessor, President Joe Biden, were commutations, meaning they did not affect fines or restitution.
