Though I do work for the state, there are layers of administration between us and it. My institution is subject to less "official" oversight, but also much more dependent on public perception and political whim than other similar institutions.

Could it be because blacks had been excluded before? Any time a white person is hired over a black the person hiring has to justify this in writting. Why do you think it is wrong for a person to justify in writing their failure to obey the law? Rather than attract attention to themselves the take the safe route and hire the black person. I even went to one interview where the fist thing the supervisor told me was that he had to interview me since I was on the list but he couldn't hire me unless al of the blacks in the top ten turned the job down. After three years they ran out of blacks to hire and I got a job. BTW I tested number two on the list and was passed over repeatedly. The law requires hiring according to a specified protocol and you have a case of the ass because they wouldn't hire you over the other qualified applicants just because you were white like in the old days[8\|]...grow the phoque up

Of course the extra points you get for being ex military is different? Unless you can demonstrate how being born black is serving the country. And even if you say that their race based bonus just canceled out my military bonus I still beat them out on the testing. "White privilage" didn't have a thing to do with my placing on the list.

In english couldn't means he is not permited to by some governing authority, where as wouldn't means he could hire you but wouldn't because he was too lazy to follow the proceedure for out of out of protocol hireing. You see those who wrote the bill recogized the posibility of "extenuating circumstances" but were not willing to allow it with nothing more than a wink and a nod. You do see the need for this proceedure don't you? Of course you do[8\|] it is the sort of thing that stands in the way of your imagined white priviledge.
