This brings to mind the gun argument about laws, "If it saves just ONE life."

Well, if spying saves just ONE life, shouldn't the same folks on the gun laws issues be backing those laws as well?

If you mean me, and I assume you do as you repeated my comment from the other thread, I would be okay to law enforcement having access to my messages PROVIDED they had a valid warrant.

I was actually not thinking of you.

I also think for some reason that this particular bill dealt only with phone metadata.

Also, there have been NO warrants issued for the NSA stuff.

However, in the US, law enforcement cannot compel you to give your password but they can force your fingerprint. So, password protect you phone/tablet/iDevice. (Even with a warrant.)

Aylee..... Can a judge not order you to hand over a password ? That way a judge decides if the police have a valid reason for looking at your phone.

No. They cannot.

Being forced to give up knowledge from inside your head is making someone testify against themselves. Not allowed.

I dont see a court order allowing peoples homes to be searched as much different from allowing phone content to be searched. Judging by your OP, I take it we agree regards the phone search issue.

well.. like I said, its not just the NSA a person/business needs to worry about.. its anyone that wants to mess with ya.. that could mean any hacker or even a stalker (that could try to hack into your phone, email, etc).. and too, with the whole "Internet of Things" thing he/she could hack your new refridgerator and spy one ya! I remember there was a news story on a family whose baby monitor (which apparently they did some basic protection on like password, etc) got hacked and the creepy perv was watching and talking to their child over it..

There's a technical term for this: paranoia. BTW; all that sort of stuff is illegal, a matter for the cops, not to mention I doubt the NSA is going to be spooking your baby crib monitor. S-s-s-shit, boy!

And since when does anything a person/business does (like encryption, vpns, etc) mean risking a trip to Gitmo??? geeze...

Since never. I was referring to the wack-o BS pulled by the right wing militias, political dirty tricksters, et al. I don't feel a need to build a bunker or buy up loads of explosives or steal ballot boxes, or make friends with Sanity, so I'm not worried about 'the knock on the door'. I sleep well at night, too. Geez...

Where exactly did I say that the NSA is going to be spooking baby crib monitors? I said people need to be vigilant and proactive to protect themselves and their info, computer, etc, from all sorts of sources, regardless of the law.. the latest is..
"e-Cigarette from China Infected Man’s Computer with Malware"
https://www.yahoo.com/tech/e-cigarette-from-china-infected-mans-computer-with-103466334849.html

Ask someone whose identity has been stolen just how much help the cops actually are (zero).. much easier to do what you can to prevent than to spend extensive time and money to repair the damage after its happened...

They can search your phone. They cannot make you give your password.

Here is an article about the case where it was laid out.

http://hamptonroads.com/2014/10/police-can-require-cellphone-fingerprint-not-pass-code

In this case, the police had the legal right to search the phone. The question in the case was: can the police force you to give up your fingerprint so they can execute a legal search? The answer to this question has long been "yes." the other question is can the police force you to verbally supply information to aid their lawful search? And the answer to that question has long been "no;" even longer than the answer to the other question has been yes.
