So... I'd say she was a little bonkers...

While there is a pretty good deal of misogyny floating around Geektopia, the way Ms Richards handled this was pretty ridiculous. And now two people have no jobs. All she had to do was go talk to them. =p I mean really, is it that hard?
I guess she was angling to become the next big feminist voice in Techland.

Ms. Richard's is the clearly the girl who cried wolf and I am not losing sleep over her current plight (which no doubt is making her and her new talent agent very happy.) but attacking her employer? Shutting down their business?

Not utterly ridiculous, that is the law. She used their image without their permission and there are laws on the books about this. Paparazzi can take pictures of celebrities and publish them, because they are generally taken in public settings, but doing what she did was illegal, it was in several of the articles I read on the case. People don't have the right to use pictures of you without your permission, it is why, for example, when you go to events and they take pictures that they wish to put on their website and such (like at a charity event), they have to get a release from the people, that it is okay to use them. When you go to a ballgame, as part of the ticket agreement, they can take your picture and use it in publicity in such, because you agree to that as part of the terms of the ticket.

As a photographer I certainly understand what you are saying here nj, but this woman is probably going to claim the photo was used for journalistic purposes and unless I'm mistaken there is a whole set of allowances for that. Am I incorrect?

*Selling* someone's image may or may not require a model release, but nobody is going to jail just for taking pictures of people at a gathering (even on private property), and putting them up on the internet.
There are specific elements needed beyond the action, in order to make it a crime.

Second, model releases are only needed if an image is used for advertising purposes. That is why pictures used for editorial purposes—textbooks, magazine articles, newspapers—don’t generally require model releases. Hence the old rule of thumb: commercial work requires a release while editorial work does not.

I should think a blog would be seen by the court as an "editorial purpose".

I hate how PC things have gotten. I find it more offensive than most jokes. My idea of a quality life does not include tip-toeing around everyone. I also find it amusing that most people I've encountered who get butthurt over some comments or jokes is not the comment itself, but the person or persons presenting it. I've had a right-wing friend go up in arms over a left-wing ad containing what she believed to have a sexual connotation. While, on Facebook, laughing at a right-wing ad having a similar connotation. I've heard co-workers get offended by a male counterparts sexual innuendos, but find it cute when a much more attractive male coworker does it.

Well, her facebook page is unavailable, as is her blog and her personal web page.

Frankly, I think she deserved to get fired based on what I read, especially Amanda Blume's (was that the right name?) article. She committed career suicide, and she has no one to blame but herself.

I don't think her blog would ever be considered "editorial content" and since she used the photo specifically to cause problems, that adds to it. I am not all that familiar with California law. I doubt there will be criminal charges brought, unless the guy with 3 kids tried to push for it. However, I do think the guy with 3 kids should file a civil suit, and I think he has a good chance at prevailing at such a suit. I also think what happens to her in the future is nothing more than she deserves. No pity for her at all.

BTW... I wonder how many people here who are so outraged by the tweeting of "the picture" roar happily why they get a new "people of Wal Mart" slideshow on their home page or inbox?

And finally, there is the Playhaven company who curiously came out of this unscathed...

Not to mention that she's apparently gotten a ton of death threats over it. I mean, keep things in perspective, people. She screwed up, and there are and should be consequences for that, but DDoSing her employer and making personal death threats are a way over-the-top overreaction.
