This isn't a case law, this is a claim filed. the article misses the depth that is required to even pass the simplest immigration requirements.

Whilst there is a provision to grant resident alien rights based on investment, it doesn't mean everything else is off the table.
The USCIS makes it very clear that there is no gurantee that because of an investment this is linked to resident alien rights as business interest can be represented by a trustee.

You are making the assumption that the resident aliens didnt meet requirements.. from what I gather about the case (so far), its the US govt changing the rules in 2012 (in how they count jobs created) that is actually the root of the problem..

"At the beginning of 2012 the USCIS announced it was re-assessing its interpretation of the job count for indirect job creation, without giving a great deal of information on the changes it required. As a result, American Life used a second economist to support the job count on all projects where visas were still being processed. Well, lets face facts, brits as a species are not the most diplomatic of creatures. (I am of Welsh, Scot, Irish, Cherokee and Apache ancestry)

They have a nasty tendency to piss people off, especially the French, (the hundred years war, and of course the Napoleonic Wars) and they have a tendency to think they know how to do things better than anyone else, including driving (they drive on the wrong side of the road.)

And we all know how the "we know better than anyone else" works, look how they ran Ireland.

What's worse, they aint even real british, they be saxons, jutes, normans but not brits, native brits are celts.

Im saying that people who want to petition to see a member of the press (YaKNOW, First Amendment, Fourth Estate, that kinda stuff) evicted from the country because he said something they don't like are a bunch of whiny little bitches.

The Scots are Picts, and there's a suspicion in some quarters that the Welsh aren't Celts either, but weird unclassified sorts who were driven into Wales by the first influx of Celts who weren't the original natives.
Possibly some of the odder and more insular types in the west country might be directly descended from bronze age celtic stock, but I wouldn't bank on it.
(It's also worth remembering, in this context, that the angles, saxons and jutes were here long before there was a Britain, which only came into existence with the Act Of Union (with Scotland) in the early eighteenth century.
