You are being glib. If you hold a kid's lemonade stand to the same standards as a restaurant, children wouldn't even be allowed to "work" there. Kind of defeats the purpose. Farmer's markets would also be regulated out of existence. Our state health department just issued a report that cites the lack of potable water at farmer's markets. Must've distracted them from all the bugs and birdshit.

Why shouldn't they obey tax laws and labor laws and carry the same insurance and licenses that everyone else has to? It's all fun and games until someone gets food poisoning and decides to sue.

Because private sales aren't the same as a regular business. With your reasoning, a kid couldn't sell a baseball card to his buddy unless he jumped through the same hoops as a Walmart. The kids in my town aren't even allowed to sled on the park hill anymore because it's a liability.

A lemonade stand is not a "private sale" between two individuals. It's a place of business open to the public, selling food that can make someone sick.
