The New York Police Department, the mayor and the city’s top prosecutors on Monday endorsed a proposal to decriminalize the open possession of small amounts of marijuana, giving an unexpected lift to an effort by Gov. Andrew M. Cuomo to cut down on the number of people arrested as a result of police stops...

Possession of small amounts of marijuana is a crime only if the marijuana is in public view or if it is being smoked in public, but many of the marijuana possession arrests have been occurring when the police order someone stopped to empty his or her pockets, making the marijuana visible...

Under Mr. Cuomo’s proposal, the state would downgrade the possession of 25 grams or less of marijuana in public view from a misdemeanor to a violation, with a maximum fine of $100 for first-time drug offenders.

Actually, in my opinion, NYC has been quite liberal about marijuana and the use and possession of it. I was born in NY and when I was a young teen (and had not yet started smoking marijuana) was transplanted down to Florida many years ago. About 20 years ago I took my husband to my old "stomping grounds" and to visit my family. While we were in Manhattan (walking towards Broadway, as a matter of fact) we lit a joint (at my sister's suggestion, who lived near the neighborhood at the time) and walked openly down the street, among the people, smoking it...passing it to each other. We passed one policeman. Not the cop, or the people around us gave us a second glance as we walked with it, although there was no visible, unrolled marijuana.

That is not the case at all in Fla, so it was a bit unnerving for me and my husband. My sister was completely comfortable doing it, though. So, IMO, NY, or at least the city have never sweated the small stuff. I guess they have other, bigger things to worry about up there. (As an aside, in my small Fla hometown, we actually have a cop nicknamed Barney Fife...and he acts just like old Barney, too!!...except I don't know if he carries only one bullet in his pocket [:D] )

I lived in Manhattan for a long time, and I have to agree. I once had a cop make me drop a joint and grind it into the sidewalk with my shoe -- so I couldn't just pick it up and light it again after he was gone, heh -- but that was the worst thing that ever happened.

Down here in Florida, the laws are fucking crazy.

Yes We Cannabis ... too bad they still leave New Yorkers with those all too useful criminal records.
In Massachusetts, the fine is $50 (adults ... there are still mandatory counseling and a stiffer fine for parents of minors) and (here's the IMPORTANT DISTINCTION) it's a civil penalty. Which means when someone runs your criminal record, it will not show up.
Massachusetts has had the law in place for years now and we've saved a FORTUNE in law enforcement costs and experienced no measurable change in marijuana use.

Like since 77 or 78?
Anybody know the scoop? I'd go to NORML and look it up, but I just hate their site.

"On December 14, 2004, New York Governor George Pataki signed into law the Drug Law Reform Act (DLRA) (2004 N.Y. Laws Ch. 738 (effective January 13, 2005)), which replaced the indeterminate sentencing scheme of the Rockefeller Drug Laws with a determinate system and reduced mandatory minimum prison sentences for non-violent felony drug offenders. The DLRA also reduced the minimum penalty for conviction on the most serious (A-I felony) drug charge in New York from 15-life to 8 years in prison for an offender with no prior felonies. In addition, the weight thresholds for the two most serious possession offenses (A-I and A-II) were doubled, and those serving life sentences were permitted to apply for re-sentencing. Since 2004, the number of prisoners serving sentences for A-I narcotics felonies has been cut by more than half.
In his first State of the State address in January 2009, New York Governor David Paterson was critical of the Rockefeller drug laws, stating, "I can’t think of a criminal justice strategy that has been more unsuccessful than the Rockefeller drug laws."[2]
In April 2009, these laws were revised to remove the mandatory minimum sentences. This change allows judges to sentence individuals convicted of drug offences to treatment or to short sentences. Also, the sentencing was made retroactive, which allows more than 1000 imprisoned convicts to apply to a court to resentence and possibly release them.[3]
New York City remains the cannabis-arrest capital of the world, with over 40,000 arrests in 2008."
