The only nail guns I have ever used had a safety feature which would of prevented this. First you had to press the tip up against a surface, then with the tip under pressure the gun fires when you pull the trigger. I find it hard to believe anyone is making a nail gun without this feature, but I am no authority. If that gun will fire without being pressed against something then I would bet there is a line of lawyers outside his hospital room already.
