One thing that no one has mentioned is that PETA is filing looking for this consideration in the US. Whale hunting doesn't happen in the US. Gorillas aren't killed for souvenirs in the US (ok, we don't have any living in the wild here, but still). Most of the real atrocities that are happening to these wild, endangered species is happening outside the US. So, what then, would PETA actually achieve? As you mentioned with Keiko, they would achieve getting custody of these whales only to have them die at their hand.

Do you think arming kayaks, surfboards and rowboats with heavy machine guns and depth charges for defensive purposes would be acceptable?

Most the normal parts of the world think leaving them alone is a better scheme.

What part of leave us alone and go play somewhere else is it you don't understand?

And don't make us give you the seal treatment.

It is a lot easier to leave them alone and for commercial fisherman to not steal the fish they spend a day rounding up and herding into some bay for their banquets, as they can tear up an offending net like you tear toilet paper, and pound a few seams loose in their boat too or filling it with water,  if they are annoyed enough at this robbery,  they are nicer then humans are in similar cases and  if they wanted to kill people they certainly could be doing that.

The dolphins the US Navy has trained as combatants look like developmentally disabled attack mice in comparison.

Why look for trouble? They are still friendly enough to us now, as long as you respect their clan "privacy" and especially don't get too close to their "children," without their approval and don't interefere with their fish harvesting once they started in an area. If they see us fishing they go elsewhere, we do the same, and everyone is happy.
