GOP candidates would cut federal judges' power
WASHINGTON (AP) — Most of the Republican presidential candidates want to wipe away lifetime tenure for federal judges, cut the budgets of courts that displease them or allow Congress to override Supreme Court rulings on constitutional issues.Any one of those proposals would significantly undercut the independence and authority of federal judges. Many of the ideas have been advanced before in campaigns to court conservative voters.http://news.yahoo.com/gop-candidates-cut-federal-judges-power-131852484.html;_ylt=AifBsqfX4X2VmeZVQxtqnVys0NUE;_ylu=X3oDMTNtN3U0ZnR2BG1pdANKdW1ib3Ryb24gRlAEcGtnA2FjYmU5MmRmLWU0ZTgtM2FlZS1iMWEyLWQ1Y2VlMzQyM2ViYQRwb3MDMwRzZWMDanVtYm90cm9uBHZlcgM3ZTBjZDUwMC1mZGFiLTExZTAtOWZmZC03NmRmNmQyMzkxMjA-;_ylg=X3oDMTFpNzk0NjhtBGludGwDdXMEbGFuZwNlbi11cwRwc3RhaWQDBHBzdGNhdANob21lBHB0A3NlY3Rpb25z;_ylv=3

And the Republicans and conservatives call democrats NAZIs.

I invoke Godwins law

But not before saying, good idea - judges were meant to have limited power from the beginning, and their power has grown to where it is now practically unlimited in scope

Judges act like fucking Nazis these days, especially the leftist judges

The People have lost all control over the judiciary.
The best way to regain that control is for *all* judges to be *elected* every four years.
Imagine owning a business and having an employee who tells you to go fuck your self in front of all the other employees, takes 20 weeks vacation every year, tells you how to run your business and makes a lot more money than "the boss?"

The people were never meant to have any power over the judiciary. That's the entire point of having an independent judiciary.

Ken, have you heard that little ditty, "A government by the people, for the people......."
It doesn't say, "A government by the judiciary, for the judiciary....."
It is *never* a good thing when a government or any part thereof wields power over the people.
They are our employees not the management and are in existence to do the bidding of "The People."
When the people don't have control over the government and the government tries to tell them what to do that's a dictatorship and probably a few other names that don't come to mind right now. I wonder what Thomas Jefferson would say about that?[:)]
So,.....if you were standing on the steps of the supreme court and one of the judges came out and told you to take your clothes off and start masturbating you'd do it?
Have you heard the term, "legislating from the bench?" Now that's not very "Independent" of them now is it?
The higher people go in position the more supervision they need.
Boy, who's the liberal here, you or me?

Thats sort of true.

It was never meant to be judges outside of the commercial constitution!

They are part of government because that is internal to government.

Not external to people!

"In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law."
Read more: http://www.revolutionary-war-and-beyond.com/7th-amendment.html#ixzz1bfHIZ9U2

They (with exception to an invisibly thin thread), they abolished the common law within the government and construed that to abolish it for the people as well.

I posted before that the jury is the COURT and JUDGE at trials, for both the fact and the law.

Take note that no facts decided by the jury can be re-examined in any court of the united states, and that is ALL COURTS withing the 50 states ARE ALL within the united states and under th judiciary act!

Then take note they are silent on who gets to judge the law, that is because the jury can also judge the law!

The laws in one state were supposed to be valid in all states but try that stunt in court sometime and see how far it gets you.

It was in the articles of confederation and the constitution and I assure you that your state ignores that when it dips into their tax receipts!

YES!  Jury courts all the way, judges as 'ADVISORY" ONLY!

Legislating from the bench is a conservative buzz word that means enforcing the high ideals this country was founded on. Without an independent judiciary the decisions of judges will be respected even less than they are now.

Judges exist not to do the bidding of the people but to be impartial arbters and protectors of the rights of all against the tyranny of the majority.

It's only far right reactionaries like you who do not understand the need for an independent judiciary.

Real0ne -> RE: GOP candidates would cut federal judges' power (10/23/2011 8:47:37 PM)

INDEPENDENT?

Are you kidding?

they are all part of one huge fucking corporation called the united states!

They are about as independent as 3m president, accounting, the board, etc etc.

man how can anyone even say something like that when they hob nob together.

the only time they are independent is when the other guy steps on their dick, then they get all sorts of independent LOL

do the bidding of the people my ass.

every see the oaths they take?  what a crock of shit.

Hell the people do not even elect them.

and who said ONE SUPREME fucking court set the standard for the who damn nation?  With judges we do not elect that the retards politicize.  (oh wait the CON said that!

There isnt too much shocks me out here but that came close.

Dom Ken, and who's going to police the judges?
Would you have liked to see George Bush with absolute power answerable to no-one?
And "legislating from the bench" can be used by any one or group. How do you ascribe it to conservatives?
And judges do work for The People, who pays their salaries and overly generous vacation and benefits? You "work" for whoever it is that pays you.
I think that The People need to have a lot more say in what our government does or doesn't do!
And you sound a lot more conservative than me in this exchange.
I want to change the government not "conserve" it like you. Who you voting for in the primary, Romney or Cain?

kalikshama -> RE: GOP candidates would cut federal judges' power (10/24/2011 4:43:33 AM)

From the link:

Minnesota Rep. Michelle Bachmann, in criticizing Iowa judges who ruled same-sex marriage legal in the state, described judges as "black-robed masters." Bachmann said Congress should prevent the courts from getting involved in the fight over same-sex marriage, among other high-profile social issues.

Youve got it popeye

As long as these activist judges are activists for far left temper tantrum causes they can do no wrong, but watch the far lefts reaction if and when the tables are turned

Yes, it was spoken by a man who forced federal sovereignty on the states via war, suspended habeus corpus, and imprisoned legislatures, and republican to boot.

And so somewhere in all that mess you haven't really got any sort of point.

Thanks for playing; parting gifts; door...

hot4bondage -> RE: GOP candidates would cut federal judges' power (10/24/2011 8:10:18 AM)

I think "judicial activism" as a conservative talking point should have ended with the SCOTUS eminent domain ruling awhile back. They upheld legislation that takes land from the owner to sells it to someone who might bring more money to the community. They let that statist, collectivist, unconstitutional law stand! Any conservatives here ok with that?

Ron if you said that in a room with 20 people in it, how many ya figure would know who that is ?

Judges are already answerable to another part of government. The mechanic is one that cons, like you, are always eager to use so I don't see what the complaint is.
