It was never meant to be judges outside of the commercial constitution! They are part of government because that is internal to government. Not external to people! I posted before that the jury is the COURT and JUDGE at trials, for both the fact and the law. Take note that no facts decided by the jury can be re-examined in any court of the united states, and that is ALL COURTS withing the 50 states ARE ALL within the united states and under th judiciary act! Then take note they are silent on who gets to judge the law, that is because the jury can also judge the law! The laws in one state were supposed to be valid in all states but try that stunt in court sometime and see how far it gets you. It was in the articles of confederation and the constitution and I assure you that your state ignores that when it dips into their tax receipts! YES! Jury courts all the way, judges as 'ADVISORY" ONLY!

I think "judicial activism" as a conservative talking point should have ended with the SCOTUS eminent domain ruling awhile back. They upheld legislation that takes land from the owner to sells it to someone who might bring more money to the community. They let that statist, collectivist, unconstitutional law stand! Any conservatives here ok with that?
