Bank of America gets padlocked after couple forecloses

In a bizarre twist, Bank of America tried to foreclose on a couple who'd never even had a mortage.

Seriously. They paid cash for their home. Naturally, this one went to court. The couple proved in court that Bank of America was fucking meshuggenah, and the judge ruled in their favor ordering the bank to pay the couple's legal fees.

But the bank didn't. Nada. Phone calls ignored. Letters ignored. Fuck off. Zip.

So (yep, this is the good part) their enough-of-this-fucking-around attorney had the bank's assets seized.

Sheriff's deputies, movers, and the Nyergers' attorney went to the bank and foreclosed on it. The attorney gave instructions to to remove desks, computers, copiers, filing cabinets and any cash in the teller's drawers.

The story ends by noting that, "after about an hour of being locked out of the bank, the bank manager handed the attorney a check for the legal fees."

Gotta love it. Had to share. Hope it makes your day.

WOOT!!! Gotta love it!!!! It took the bank manager a whole hour to decide to do the right thing??? Dumbass!!

In the early 80's when interest rates rose, the banks went through all their low-interest rate mortgages to find some loophole they could use to foreclose on them. My parents had such a loan. They had paid every single payment on time, but the bank discovered that the month the house sold no payment was made. So they were served with a notice of a Sheriff's sale & told they had 3 days to vacate.

Turns out it was the seller's responsibility to make that payment. My mother was a big crazy Norwegian who always reminded me of Brunhilde in the Wagner Operas. She went down to that bank & explained the facts of life to them & they practically got down on their knees & licked her feet. LMAO She was sumpin else!!!

The banks are completely out of control. Washington Mutual used to have all of my business, personal accounts, business accounts, mortgage and even a credit card. So one day they decided to let a guy 1300 miles away, 10 years older than me, different race with improper ID take all the money out of my primary account. I caught it with 15 minutes because I check my bank balances frequently. So I do the whole "by the book" report the fraud to the bank, the 3 credit bureaus, the police dept locally and in the city it was completed in etc.

So then the fraud department makes me spend 60 hours on the phone, sends me a letter calling me a liar in writing, refusing to refund the money, and holds it 3 weeks releasing it only after a detective in the state the fraud happened said he got the video tape from the branch and thought they were going to catch the guy.

By then, since they had essentially all of my money for a month, I had late fees on everything, and my credit cards, including there's jacked my interest from 7.9% to 29-31%.

As if that weren't enough insult and injury....and all of which they said sorry about your luck to, they then started calling on my mortgage by the 3rd of the month each month, dozens of times insisting I pay over the phone immediately, even though I have a grace period till the 16th each month.

Finally, I used the Fair Debt Collection Act and sent them registered letters return receipt to stop the calls. Still the persisted, 87 times in fact, until I talked with a VP at JP Morgan Chase and told her that a)In Texas, it is legal and admissable in court to record any conversation on my phone with or without knowledge or consent and b) because I had not one but two signed receipts showing they had received a cease call letter twice, that each call was a seperate injunction I could file worth $1000 a pop out of court.

Needless to say, the calls stopped, and if they hadn't, I wouldn't have had a mortgage to worry about because they would have paid it off for me.

I'd love to find an attorney that could take the fine print contracts that we all sign off on (and that get updated by mail in your bill periodically changing the terms) that would write a contract from the consumer to the company, changing the terms unless they respond in writing by 2 days after they receive the letter. It would be great to get a contract like that if it would hold up in court, then post it on the web for free for everyone to use.

Something like that would cause the banks to either bleed to death from having to staff up to handle the influx of change in terms letters or by knocking off all of their highly lucrative shenanigans.

Banks forget that they have a fiduciary responsibility to safeguard your money...that's what banking is primarily for, to safely store your money.

I dunno.  In egregious cases like this, in which a bank essentially tries to take something that is not even theirs, we ought to be able to charge the company C level officers criminally.

Yeah, BofA is just as bad as Wauchovia......I love to see the little guy win!  And I'll bet more and more folks try to do the same now that they know about it!

Wow. That is just scary. Were you able to take any legal recourse for liable since they called you a liar in writing? What made you decide not to pursue the $1000 against them for each of the times they disregarded your "cease calls" letter?

I couldn't agree more. The article stated this wasn't the first time this had happened. If so, banks need to take responsibility for their careless actions and be held to the same standards everyone else is held to.

My neighbor had the bank mess up her payment.   I had a grave look of alarm when she explained it.

Luckily-  her payment was AN EXTRA payment to pay it down-  not the regular payment.

The crazy bounced check and misc fees now being done for mortgages.

There is no excuse for a bounced check. I mean there is when people get stupid and take the "easy" way allowing electronic credits and debits on their main checking, but that excuse is not accepted. They let it happen for the fees, and to correct the situation you basically have to let them hold your slush fund. I worked for a place that bounced my paychecks quite a bit. Well that made it necessary for me to maintain a slush fund. Actually I cashed the checks on savings and transferred the money to checking.

Friend of mine paid his house payment every month by certified check via certified mail, requiring a signature. Everyone thought he was crazy, and actually he is, but that's beside the point. One day the notice came - Where is the payment ? He calls, he has a reciept that the mail had been signed for. What was really outrageous was the fact that the person on the phone was the one who actually signed for it !

Using such tactics is a ploy to get us to not use checks, or even money. The banks want all the money in the banks. Go figure. But any sane person would ask, if money and drafts and all this is not good for us, why do YOU want it ?

It's pretty fucking apparent to me what is going on. Y'know I was thinking about how to rebuild my credit, I have the means. But really, maybe I just shouldn't bother. I've talked to a couple of friends who have no credit. They don't have bad credit, they just never got credit. Rare these days I know, but some people simply live within their means. So now people with good credit can't get loans, people with bad credit can't get loans and perople with no credit can't get loans. Fuck it then right ?

The best way to get a loan is to prove you don't need it. Sorry about the banking industry but my Daddy told me, you are the customer at the bank. They make money on interest by giving loans. No borrowing, no interst. No interest, no income. Sorry about their luck. It's going to be an intersting next few years.

Term,   the banks arrange bounce check fees highest amount first- not in chronological order- so that more fees build up.   So a bounced check of even $1, can end up to be $600 in fees-

Ummm, not so fast. I got a buddy who went overdrawn by a few dollars at the bank. The fee was thirty dollars every three business days until it got paid off and they would not let him close the account until he made alot of noise.

Whiuch reminds me, I need someone to write me a check for $1.71 exactly, preferably drawn on an out of state bank, and not the same bank that I am proceeding to fuck with. Actually I'm not even sure if I care if it bounces.
