I've been unemployed for one year now. Working per diem time jobs and collecting unemployment. Trying to keep up and doing OK. This month a couple of things came up and I need a little break in my monthly bills. Soooo, I called the car loan company and asked for a deferrment. I've had this loan for 2 years and not once been late with a payment. Soooo, after being shuffled thru numerous " associates " I finally get some one who can help, so they say. She asks me if I have a " hardship ", to which I reply yes, I have been unemployed for a year. She tells me she is going to check my account. She comes back and asks me again what my hardship is and I repeat myself. Her response was something like: I just looked at your account and it looks like you have been paying on time since you became unemployed a year ago, so what is your problem this month ? I explain my situation and she tells me that the company will not give me a deferrment unless I am employed. And proceeds to give me a lecture about trying a little harder to get a job and being more responsible with my finances, which I quickly interupted with a litany of my own thoughts on her and her company.

WTF ? Being unemployed is not a hardship, but there is some unknown quantity that catagorizes you as having a hardship if you have a job. Well..... color me a fucking moron. AFter I settle down a bit, I think I am going to write a nice little letter to the CEO of the company and give them a piece of my mind. I know it won't get me any action, but I will feel a whole lot better.

Rather than call I would've sold the radio out of the car to make the payment. Now the damage is done, they know you are unemployed.

Secured credit works like this : you get someone to partially pay for something and then take it away. Win win. Now they probably have a repo man on call, waiting for one day of the month at 12:01 AM to take the car in the middle of the night if your check isn't there.

They also have the right (for no reason) to call the note due in full on any given day. It's in the UCC and it's called "Option to accelerate at will".

In the future I advise that you NEVER EVER reveal any financial hardship to a creditor. This is not the same thing as paying the water bill a couple of months late (which I do all the time).

If you are going to maintain good credit, which I did for about twenty years, nothing gets in the way of that payment. Many years ago it came down to food or making the house payment. I was hungry. But now I'm not cold.

What I'm saying is that anything that involves a cognovant (sp) note comes first. That means even if it's to the point that the phone or electricity gets shut off. This is much better in the long run.

Ditto to the trying a new rep - perhaps a supervisor - and with the best wishes.

Also, my credit card company gives me an unasked deferment every year at Xmas. This is surely a marketing tactic, but perhaps you would have better luck with your credit card companies (if applicable.)

Unhelpful patronising people could perhaps do with a dose of reality themselves, did you get their name, always get a name and inform the management that a certain member of staff is in need of some further training.

Maybe it's not much of a car. My point is the note is worth more. Don't screwem now, wait until later and screwem for more. It's too bad you can't just go to the dealership mid term and say " I can't afford this, can I trade down ? ". It's not like renting.

You can evade the repo man, but not Transunion. You could total the car, but then there's Choicepoint. Pay more interest or insurance next time, your choice.

Of course I am a bit off center when it comes to cars. I WANT cars that have problems. I fix them, drive them for a while and then usually make a few bucks on them, unless I smash them or something. Send me your huddled masses of burnt out transmissions and blown engines. Bullet holes, leaking gas, and broken glass. " She starts right up and runs fine you say ? What else do you have ? ". "Six mechanics couldn't fix it", that's when my wallet comes out.

But normal peopple usually get car loans. That's credit, and that gets paid first.

That's how I see it.

If you don't get a satisfactory answer from one person, always ask for a manager. The average customer service person has set guidelines and quite often, cannot deviate from those guide lines. Make sure you are talking to someone with the authority to made decisions outside the norm.

Flcouple: I think that's a good idea and will do it tomorrow. I suspect that I will get the same answer. I kept it brief, but this particular company supposedly has a policy of not allowing deferment, unless employed. But I will double check.

Termy: The note will be paid this month. I was looking to ease myself up a bit.I hate playing it close to the vest with money. I have had many car loans and other loans and I have never run into a company that did not allow one deferment a year. The company I took the loan out with sold the loan to another company: Wells Fargo. The original company I have done business with since I was in my 20's and have on occasion taken a deferment. So, stupid me, * assumed * it would not be a problem. And i don't give a rats' ass if they know I'm unemployed. They can't do a blessed thing to me as long as I keep paying them. Despite my current situation, my credit remains unscathed.

Anernin: Ohh yes. I most certainly did get that bitches name, full name. And she will be one of the center pieces of the letter I write. I may have been pissed if she just declined me due to policy, but it would have passed. The fact that she questioned me as to why I have been paying my bill for a year < hmm, maybe it has something to do with trying to stay responsible to my obligations > and then asked me what's different this month. And when I said: after a year, things have gotten a little tight. And she said that didn't make sense. It was a tone and attitude. And while I do not wish bad things on people, IF she ever have the misfortune of getting in a bind someday, I hope some one gives her a tatte of her own medicine 10 fold.

LaT: yep, yu're right and tomorrow when I call I am asking for a manager. That will be the follow up call that Flcouple suggested.

The person who bags your groceries is ,.....an "Associate."
Work at Walmart? "Associate."
Used to be an "Associate" made good money and a full benefits package in this country.

Minutes after I wrote my last post, I got a call that I have been chosen for the job I have been holding out for.
So now I will be a Federal Associate. !!!! Yeah me.
She can kiss my ass.

Oh man....Wells Fargo....now Wauchovia.  Yeah, they are truly bastards about their loans.  I made a payment for 4 months of my car loan at once, having moved to start a job, and I wanted the breathing space, and I had the extra money.

Well, I needed an extra month, and called to get a deferment too.  They denied it, saying that since I hadn't made a payment in 75 days, that I was "ineligible".  WTF??????  After about a week wrangling with their idiocy, I finally got ( what I thought) was permission for the deferment.....I had the forethought to get the guys name....so I'm waiting for the papaerwork to come, don't make the payment, and then the calls start.  I explained that I'd been given a derferment, I was waiting for the paperwork, etc.  Imagine my surprise when there was no indication from the idiot that gave me the OK in the files.  When I told the other caller his name, he told me that he had no authority to grant that.  So now, I'm past due and have to come up with 2 months worth of payments.

I will never do business with WF/Waucovia again in any way shape or form.  They ended up taking the vehicle in the middle of the night while I was trying to get this worked out.  Rat Bastards!

...the bank came to repo my brothers truck.  The kicker is he paid cash for it and it never had a loan on it- EVER.
