 I am beyond pissed right now. This morning a good friend of mine text messaged me and said, hey I have a question for you. I told him to ask. He asked me if I had videos and pictures on a site called rude.com. I said, no. I have NEVER heard of that site.

He told me I had to go look because there were pics of me on the site. He said it had to be me because of my tattoos. So I went and looked and it was / is me. My former "daddy" has posted ever picture, ever video we have ever done. Every piece of content I have on my site is on his site. He NEVER had my permission written or otherwise.

I dont know what to do.

To make it worse its not just ME there are dozens of women on his site. If he didn't tell me and we were in a relationship do these other women know?

If anyone knows how I should handle this please contact ASAP.

Sounds like a difficult and slippery slope with variables that may, or may not, give you any options.

I would suggest talking to an attorney. Then, to avoid future problems...........don't do that shit again. I guarantee NO ONE has anything of me, I wasn't perfectly comfortable with ANYONE seeing.

Word of advice? Don't make the videos accessible unless you're ready for the world to see. You shouldn't have left the videos with him to begin with if you didn't want him to use them in whatever way he wanted.

If you did it as an item the videos belong to him just as much as they're yours. You left them with him.

No, to post pictures or videos on an adult site to be sold you have to have prof of ID and a model release form.
These pictures and videos were taken for the sole purpose to be used on my fetish site. He NEVER had persmission to use them for ANYTHING.

I think she is referring to 2 separate things:
1) she has her own website and he has stolen some of her materials
and
2) videos and photos they have done together

As for the ones that you see as co-owned, under rude.com's copyright policy, he is in violation of their TOS:
"d) You have acquired the permission of any person appearing in any of Your Uploaded Materials to upload such person’s image(s) and appearances to the Website;".

Start a DMCA with rude.com and ask that they remove the images/videos within 24 hours.

Give them the URLs and say the images/videos are yours and used without your permission.

I'm sorry you're embarrassed, but a good rule of the internet is to never post anything unless you assume that the whole world will see it.  :/

Unless they're making money off your photos somehow, and you have a copyright notice on your site with these pictures, I don't think you can do anything.

Ohh..I thought it was all the same. My bad.

However, based on scant information provided your situation sounds pretty hopeless, unless you made an explicit contract about the pictures'/videos' usage and your personal page has a disclaimer etc. but nevertheless they're violating the policy of rude.com so you should at least be able to get them removed from there.

I'm sorry for not making my OP more clear.
I have a paid fetish site. He has posted MY content that we made together on his paid site on rude.com without my permission.

I have gotten some good advice from here and from the man who hosts my site.
So now I need to write an email to rude.com linking all of my pictures and videos and the fact that he did not have my permission to post them which does violate their TOS.

Yes, I feel betrayed because of the business aspect of it but I also feel betrayed because this is a man I was in a relationship with. This is a man who I called my daddy, who I gave all of me to.

Ive been told that getting an lawyer might be something I need to consider so he doesn't do this again or to anyone else. Like I said there are dozens of women on his site and I didnt know... do they?

I know some people think.. oh you have a website, whats the big deal. It is a big deal. I'm prepared to answer questions and deal with backlash from MY site. I wasn't prepared for this. I wasn't prepared for him to make a profit of my pictures and things without my permission, in my eyes that is theft among things.

Thar be this lil thing called the 18 U.S.C. 2257 and yer not on it. That makes it all very illegal. I would urge you to contact an attorney, have him/her find the posting dates and pursue legal action. They will pull them and you will be able to settle for a hefty sum... at least from revenue x date to x date, if not from more measures your council advises you to take.

Yes, my company is being sued under this even though we took the offending page down within 24 hours. Whenever we get a DMCA, we take the page down immediately without challenging it even though we probably could under free speech. (Alas, no model permissions are needed for our sites, would make for a more interesting workplace :)

2257 paperwork is for age verification (granted, they are necessary as the owner of a site displaying content). rude.com isn't actually "his" site (if it was, e-mailing them would be pointless). Is he actually making money off of them or are they publicly accessible?

In any event, contacting the site about Terms violations is a good idea. If you are intending to pursue legal action, you may want to speak with an attorney first so as to check whether acquiring visual evidence of his posting the content there would be useful before the images and videos are removed by the site.

As an aside, the person who takes the photograph or video usually owns it. Not the subject. Usually even without a release form.

However, like mentioned, it violates their TOS and probably the Age Verification code. (Not that the internet is all that well enforced.)

THAT is one thing I did make sure I did with anyone who has taken pics/ vids of me for my site (I use several photographers). I have them sign a form stating that all pictures and videos are owned by me and that they may not be used without my written permission or consent.
