Well I guess I'll be the first to comment on this one. First to be flippant, one - and they think WE'RE kinky ? Second, he better have money for F. Lee Bailey. He's lucky not to be in Ohio because Bailey refuses to practice law here last I heard.

All kidding aside, this dumb fuck is just making it easier for the gun control nuts to find a talking point. YOU ONLY BRING OUT A LOADED GUN WHEN YOU NEED IT. Plenty of times guns come out around here, lookie what I just bought, but as it is passed around the table, first it is inspected by the owner to make sure it is not loaded. And then at least around me, each and every person who handles it MUST make sure for himself that it is not loaded. What's more that it is not chambered. You can take the clip out of an automatic but if it is chambered it is still loaded.

I am the MOST staunch supporter of the second amendment, his gun rights should not, and cannot be revoked because it is inalienable. But through his assholishness he killed someone. He needs to be put away. This is one of those cases where even if it was an accident he needs to go away for a long time, and really I couldn't make much of a case against executing him. This was so fucking careless it sucks. I mean if he meant to do it he needs to get sent up or whacked. If it was an accident he needs to get sent up or whacked. There are no excuses when it comes to killing.

See people play with knives. Knives are quite difficult to disable. If anyone must engage in this kind of play, then they should file the firing pin which would disable the firearm. All he has to do for effect is not tell her.

The way I see it this must've been some sort of rape fantasy, those are extremely dangerous no matter how they are played. What's more it doesn't matter if he intended to do it or not. If you make a mistake and shoot someone when you percieve danger, that's one thing. That was obviously not the case here. If he meant to do it, he could actually plead stupidity, because there are alot more ways to kill someone. However that might have been planned as the defense.

What if she had a life insurance policy or he was in her will ?

Unfortunatley it would take a Vulcan mind meld to find out. But it's a moot point. I know people who got out for murder in 11 years, while others do life. And then some do more than 11 years for lesser crimes.

ETA : Forget the part about the life insurance or will, I'm pretty sure if you kill someone you can't collect anyway.

The article won't load for me however this sort of death is exactly why I'm not a fan of gun play. It's one of the few things where I get really nervous about even hearing others talk about it. I get this sinking feeling that I'm going to become an accessory.

Another option would be for him (if he has multiple guns) to make absolutely certain one gun is never, EVER loaded (I'm thinking like never even buying ammo for it) and one gun (or more than one) that is loaded for other uses. Again, he needn't tell her it's a gun for which he never has or ever will buy ammo for. That way, she can think it's real and loaded all day long and get whatever kicks she wants out of it. But he will know that it's no more dangerous than a paper weight.

Ok sure hope someone checks her will and life insurance.
I grew up around guns, they aren't toys.
I'm with Aqua, not into gun play.

So we have only one survivor and this is his story.

Since nobody else mentioned it... he is 23 and she is fifty.  How long had they been married?  How much was her life insurance for?

I hate to think that anyone would be prosecuted for things that both consented to.  That said though, death is like a hard limit.  To me, if you are dumb enough to "accidentally" shoot your lover in the head with a gun "you didn't know was loaded", you need to be locked up.  Accident or not, you shouldn't be roaming the world unsupervised.

I won't even comment on the age difference. I would like to see how much life insurance she had though.  (Ok, that is kind of a comment, but it is really nice compared to what I am thinking!)

However, the only real difference in this would be the determination between manslaughter and murder.  Should mean that any conviction means no insurance.

That's true. The fact that he is admitting to pulling the trigger at all kinda makes me think it's not about the insurance unless he's got some clever plan to have someone else get it and give it to him.

Most people are smart enough to check the clauses before they commit insurance fraud. Hence the point of making it look like something it wasn't. I'm not aware of any attempted insurance fraud cases where the murderer didn't bother checking before offing the victim though I'm sure a handful of such idiots exist. I just doubt they exist in any number worth mentioning. I'd consider it far more likely that someone loaded the gun without telling him than he decided to risk everything he has in the world to commit murder without making sure that he could get the money.

Death is LIKE a hard limit ? Really. If so what is it "like" ? Like when you were a kid with an older sibling making you smell their feet ? (I did that to my sinister when we were little, but only from time to time)

If death is LIKE a hard limit, I would really like to know EXACTLY what a hard limit would be. You sound like fun !
