Hi folks--

Anyone heard what opinion the Tea Party has about the latest SCOTUS ruling on states' rights?  I generally have seen that they are strong backers of states' rights.

Where does that leave them when the SCOTUS says that fed trumps states when it comes to gun regulations (McDonald v. Chicago)?

Enquiring minds want to know.

They don't care about states' rights; they care about people having more guns. When it is a choice about states’ rights or any right wing policy or having a conservative president elected, states’ rights are irrelevant.

I have been wondering when the "Tea party" was going to start bitching about BP and how the GOP want the taxpayers to pick up the tab for the clean-up??? 

You know how they hate the role of government and all the expenses the tax payers are forced to pay.  Perhaps the man with the money behind them has them silent

In favor of.  Look, as an American citizen, I have the Constitutional right to bear arms and protect myself from intruders and the government. 

With that being said, I don't see why people sneer and snub their noses at classes for gun safety and that kind of thing.  Not everyone has the blessing of being brought up around guns, learning to hunt, and gaining a healthy respect for guns and their function.  I know there are people who don't like guns and I respect that opinion.  I just wish y'all would stop infringing upon my right as an American to own them.

Simple, many people love states rights when it serves their agenda. Those same people hate states rights when it doesn't.

I'm not seeking to "infringe" on anyone's right....just wondering where the complaint department is when my right to live gets "infringed" on by some asshole who is having a bad day.....and seeks to alleviate his frustrations by firing off a few rounds of his constitutionally protected firearm?
And as a complete aside would it not concern you to have a Supreme Court so in ideological lockstep with each other that they could agree on any case before them in such a lopsided manner?
Or do you assume the issues argued before them are that black and white?

-Smiles.-  That's a really huge assumption that people who legally own their guns go off the deep end all of the time.  I own my guns, and right now I'm in a very, very, very bad mood.  I don't feel it's necessary to kill people because of it, and most of us feel that way as well.  Did this persona legally purchase this gun? 

As far as the aside, in this case, I believe it is very black and white.  It explicitly states within the Constitution that, "A well regulated militia, being necessary to the security of a free state, the right of the people to KEEP and BEAR arms shall NOT be infringed."  I don't think that that's any blacker or whiter. 

In other cases, they may not be so black or white.

I support the law that Arizona passed.  If the federal government were doing its job, Arizona wouldn't have to stick up for itself.  Bush didn't do shit, Obama's not doing anything, the people before them didn't do anything.  When the government refuses to do its job, the states must rise up before America and do what they must to protect their constituents.

Please point out to me where I stated in my post that everyone who owns a gun is a potential spree killer?
Point in fact all I need do is run into one....just one such asshole....and once again I'm looking for the complaint departement [:)]
Back to the aside.....of course there are shades of grey.....and your inability to see them is part of the problem....An example: me and a group of like minded folks establish a community where we seek to raise our children safe from the potential tragedy of gun ownership...In furtherance of that goal we enact local ordinances banning firearms within the community.
Charlton Heston wannabe moves into our community and challenges said laws....where do our rights and desires stand against the Heston guys Constitutional right to bear arms?

The States Rights issue is a non starter on the issue of the 2nd amendment.

The focus of the States rights argument is very simply found in the 10th amendment.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The right to keep and bear arms is an individual right enumerated by the 2nd amendment.
      (at least that is the latest finding by the SCOTUS) and that means it is reserved by the constitution for the individual people same as the right to freedom of religion, freedom of the press, the right to a fair and speedy trial. the right to not self incriminate,  all individual rights protected by the US Constitution including protection from state and local governments trampling on them.

My dad's by no means a moderate (we agree to disagree and don't watch Fox News together) but even he thinks there should be limits on some types of guns.  He did a stint in the Army and thinks that's were the machine guns and "assault" type weapons should stay.

Well, here's another example.  Many in the Tea Party (and general conservatives) believe in small government but also supported No Child Left Behind, which was a huge, poorly funded mandate on the states.  As a previous poster noted, often views don't seem to be based in a pure big gov/small gov POV but more in which view will get me what I desire.

note: I don't have a pure-Fed/pure-state view myself.  I think there are some jobs that the states are simply unable to cope with (which is where we got welfare and Social Security from; the states couldn't handle the load) and some the states are better off handling.

I'd disagree with him.  I have had the opportunity to shoot both machine gun and a variety of assault rifles.  I don't see the harm in owning them as long as they are properly secured and handled.
