Woman quit paying rent after being ordered to remove an Easter decoration with peeps.  She's claiming that when she was told to throw the things out, that nullified her lease.

i think she was perfectly justified. Isn't that in the Bill of Rights somewhere? The right to bear Peeps?

I read the article and can't figure out how she thinks it nullified her lease. Just seems pretty bizarre over all, but then again, I don't doubt that whoever wrote the article either left out, or didn't know all the pertinent facts that might make the whole thing seem to make at least a little sense.

It DOESN'T make sense.  It sounds like she went nuts after being told that she could not have her Easter decoration because it looked tacky (or whatever reason).  Some judges would have ruled the whole Peeps thing inadmissible, but this one evidently likes some fun.

Bottom line, you don't pay rent, you get evicted, and she has no defense.

Some time ago when this was first "news" one article (I do not have time to hunt it down at the moment) said that as the display was edible the manager and other residents were concerned about it attracting bugs or otherwise posing a health hazard and so she was asked to take it down.

She feels this violated her rights as displays are allowed and no one else had to take theirs down and therefore quit paying her rent.

There is actually a legal question under all this.

She claims she was evicted for refusing to take down the display and stopped paying rent after being served the notice.

The apartment building claims she stopped paying rent first and then was evicted.

I love it!  Especially the part where it says she lives in Gunbarrel, CO.

I am crazy enough that I would go watch the trial if I were able to, just to hear the legal arguments.  I bet, once you get done giggling, it will be interesting.

I have to admit that my biggest laugh came from the comments section below the article though.....

Obviously the manager had never tried to eat one or he wouldn't have said that.

actually that is pretty common rule about rubbish.   Most buildings do have limits on that.  I got in trouble for having a US flag up- in the 80s.

Here in Canada, not sure how it is over there if you have a problem with your landlord or whatever you file a claim with the Rent Tribunal and get a hearing and then they decide the outcome, financial compensation etc. The main point is though you have to keep paying your rent to qualify.

I do remember going on rent strike in Manhattan due to unlawful and dangerous asbestos removal and we put our rent in an escrow account, we didnt pay the landlord. I am not sure what the difference is between the countries, provinces and states but basically if you have an issue, you can fight it as long as the rent is there in some sort of account or is paid out right. They also charge for the forms so you need to put that money out as well. Not too bad, like 50 bucks. I know a woman who took her landlord to court for neglect, like she got electric shocks touching the bathroom sink, she had two small kids and she got a lump of money at the end of it.

So what's the difference?  Either way, she's being ordered out, and she owes back rent for the time she was living there and not paying.  What is so different about the two scenarios that a jury trial needs to decide something?

Salient points:

1. Burdick is showing off a home-built diorama of her former apartment complex. She told friends who came to the trial today that she built the model at a Peep scale, and included Peeps as people whom she knew in the apartments. It's therapeutic, she said, to use the candies in something lighthearted.

2. Burdick said she closed on a house in Longmont using cash from an inheritance and immediately moved out of the apartment. She asked the jury to award her $700 in associated moving costs and $299 for the security deposit on the apartment that was never returned. 

So she broke the lease, and is trying to recover her SD as well as moving costs (!), using an argument that she never would have bought the house and moved were it not for the Peeps eviction...

--  I am not crazy over silly decorations.  Some houses have them here.  Luckily it is not too over done in this section.
