How often do doublecheck the TOS when makeing a purchase?

http://www.ourstrangeworld.net/index.php/main/article/selling_your_soul_online/

(quote from the link)

"United Kingdom - A computer game retailer revealed that it legally owns the souls of thousands of people who have visited their website, thanks to a clause in the terms and conditions agreed to by online shoppers.

The retailer, British firm GameStation, added the “immortal soul clause” to the contract signed before making any online purchases earlier this month. It states that customers grant the company the right to claim their soul.

“By placing an order via this Web site on the first day of the fourth month of the year 2010 Anno Domini, you agree to grant us a non transferable option to claim, for now and for ever more, your immortal soul. Should We wish to exercise this option, you agree to surrender your immortal soul, and any claim you may have on it, within 5 (five) working days of receiving written notification from gamesation.co.uk or one of its duly authorized minions.”

GameStation’s form also points out that “we reserve the right to serve such notice in 6 (six) foot high letters of fire, however we can accept no liability for any loss or damage caused by such an act. If you (a) do not believe you have an immortal soul, (b) have already given it to another party, or (c) do not wish to grant us such a license, please click the link below to nullify this sub-clause and proceed with your transaction.”

The terms of service were updated on April Fool’s Day as a gag, but the retailer did so to make a very real point: No one reads the online terms and conditions of shopping, and companies are free to insert whatever language they want into the documents.

While all shoppers during the test were given a simple tick box option to opt out, very few did this, which would have also rewarded them with a £5 voucher.

Due to the number of people who ticked the box, GameStation claims as many as 88 percent of people do not read the terms and conditions of a Web site before they make a purchase.

The company noted that it would not be enforcing the ownership rights, and planned to e-mail customers nullifying any claim on their soul."

Are you talking about the TOS for the CM site?

SocratesNot -> RE: Do you read the TOS? (6/13/2010 6:10:51 AM)

Frankly, I never read TOS, well almost never.
However, I did few times suspect that some strange things can be inside TOS, but still this wasn't enough to force me to read it in its entirety.
I do however read rules for forums, because they usually contain some useful info, are more specific and do not contain too much abstract legal stuff.

No i ment it as a rhetorical question after reading the link. Some company in Europe put in their TOS that by agreeing to the terms they will 'own your sole'. After thinking about it, i Never read them and was wondering if anyone else actually does.

Holly, really? You're asking this question? Did you read anything beyond the title on the thread?
I generally find your posts interesting, or at least amusing, but come on - did you really think this was about CM's TOS?

Wow. Just, wow.

I jumped through because I damn well pleased.

Did you ever read the end user agreement for alot of software ? The license agreement that you tick the box before it lets you hit OK. Let me explain that in something other than legalese.

You own nothing. Even though you may have paid for Windows, you do not own it.

You are forbidden from decompiling it to find out what is in it.

You, whether you decompile it or not are forbidden from modifying it except in ways that it allows.

You may not share it with others. You also may not copy it.

You may not use it on more than one computer.

You better hold on to the disk, even though we claim it's not the disk but what is on it, we have no responsibility to you or anyone to maintain it's usefeulness to you or anyone else.

If this screws up your system, we are held harmless. You pay.

If you think this is a joke (I guess the OP was kinda) get someone like That Dave Guy in here, anyone familiar with the Windows deal will tell you it is all true. I mean this is no joke at all. How many people actually read all that gobbletygook ? But that's what it says.

Of course over here things are a bit different. My copy of Windows was "acquired" and the product key is not in question. This one can be cloned over a network and result in 4,000 PCs using the same key. It's the corporate edition. It is much faster to just load it once and clone it to other PCs which are identical. All perfectly legal I assure you.

But when you get XP Home you have a few other things up the dupa.

Now you must register within thirty days or it just stops working. Did your money stop working ? (don't even answer that)

If you change too many peripherals you must reregister.

You can't just stick your harddrive in another PC like you could with 98 and have it work. (true of all versions of XP or higher)

Back in the 98 days I could change PCs like underwear. There was a trick to it, in control panel just remove all the system devices and they would be rebuilt on the next (long) reboot. Now XP just sits there with it's thumb up it's ass. AND IT COSTS MORE.

Fukum. I got a master product key for Word, Works, Office, all that shit. Works on everything. What's more that software was legally bought and paid for and is no longer in use. Therefore what I have is considerd salvage by me. You wanna call it stealing you go right ahead. It's put well by Georse Thoroughgood - Now you funny too.

I know the OP was intended to be somewhat of a joke, little bit, but this is not. The fact is, in many things if you read the end user license agreement along with all the limitations of use, as well as the "sellers" limited liability for any damages, you would likely not agree. Hell I got Linux for free. Three different versions as well as Lindows. I could tell Bill Gates to kiss my ass anytime I choose. But if it screws up the firmware on any one of my motherboards I might actually have to change a chip, which is very hard to do, or replace the motherboard. Guess what, the deal is the same if I use Linux in whatever form, which is open source, or Windows which I would pay through the nose for.

Damn, I should've let that typo stand. I hit an extra "o" turning nose into noose. Freudian slip ? Anyone wearing one, saying what they really mean ?

The crap thing about TOS is you have zero input. You either agree or you can't use the product.

I appreciate folks that make that stuff amusing. I read one once in normal speak - we won't give your info out, you don't sell our stuff. It was called "the necessary legal mumbo jumbo or something.

CM TOS? I have read them a couple of times. I sometimes look for something particular. But then, I'm a wordsmith and a geek!

Hiyas 21;

Just thought I would take a moment to say that overall, we are much more comfortable under your reign than that of 11. She was OK, but it was hard to breathe so to speak.

But I, after a time have figured out that CM is trying to put up a certain image. Not to say an untrue image, but the image of us kinksters, that we are not summarily to be considered rapists or molesters and that we have pretty much opinions like the vanillas. That we give thought to our actions, and sometimes action to our thought. Human fucking beings.

Religious fucks and activists usually can't even grasp such a concept, which makes it an uphill battle. Understand that I am also aware that there are those who wish no contact with our kind, and I will respect that. Like the Bible belt Baptists or whaever. OK, we agree to stay away from one another. Oh, wait, someone might accuse me of being a racist because what I just said would be tantamount to segregation.

DCWoody -> RE: Do you read the TOS? (6/17/2010 12:18:56 PM)

I don't read TOS,  EULA etc, because...well, cba ofc, but also I have a rough idea of consumer rights in this country, and know most of what's written in them is either stuff you'd assume anyways (no stealing this, it's our copyright, no hacking) or stuff that just isn't true....they can write whatever they want about what will & won't void your warrantly, doesn't make any difference to the infamous statutory rights. Ya can fairly safely ignore them, unless you're looking for legal loopholes to screw the company somehow, they're irrelevant.

domiguy -> RE: Do you read the TOS? (6/17/2010 12:19:54 PM)

I write the TOS for CM...That is why I haven't been moderated. I know all of the loopholes.
