Baffled by Health Plan? So Are Some Lawmakers

In a new report, the Congressional Research Service says the law may have significant unintended consequences for the “personal health insurance coverage” of senators, representatives and their staff members.

For example, it says, the law may “remove members of Congress and Congressional staff” from their current coverage, in the Federal Employees Health Benefits Program, before any alternatives are available.

The confusion raises the inevitable question: If they did not know exactly what they were doing to themselves, did lawmakers who wrote and passed the bill fully grasp the details of how it would influence the lives of other Americans?

The law promises that people can keep coverage they like, largely unchanged. For members of Congress and their aides, the federal employees health program offers much to like. But, the report says, the men and women who wrote the law may find that the guarantee of stability does not apply to them.

“It is unclear whether members of Congress and Congressional staff who are currently participating in F.E.H.B.P. may be able to retain this coverage,” the research service said in an 8,100-word memorandum.

The law apparently bars members of Congress from the federal employees health program, on the assumption that lawmakers should join many of their constituents in getting coverage through new state-based markets known as insurance exchanges.

But the research service found that this provision was written in an imprecise, confusing way, so it is not clear when it takes effect.

The new exchanges do not have to be in operation until 2014. But because of a possible “drafting error,” the report says, Congress did not specify an effective date for the section excluding lawmakers from the existing program.

Under well-established canons of statutory interpretation, the report said, “a law takes effect on the date of its enactment” unless Congress clearly specifies otherwise. And Congress did not specify any other effective date for this part of the health care law. The law was enacted when President Obama signed it three weeks ago.


I have no doubt that the law will be swifty .... and very quietly .... amended.

But it's a hilarious example of unintended consequences, anyway.  [:D]

Oh yes! They'll have that little glitch ironed out by conference call, and in a completely bipartisan way I bet, long before they get back into session.

I do not doubt that you are right.
If in fact we are both right then this would beg the question:
If they can work together rapidly to fix things that affect them why could not this bill have been handled in the same manner.
You and I both know the answer is that they are all crooks and only interested in feathering their own nests.
There is no doubt in my mind that this bill will only make money for the insurance,pharmaceutical and medical interests and the the people will continue being bent over.

Yeah- I know all about the RFIDS, the forced vax and the death panels.  and I also know compliance will be dismal.

I actually do have a copy of the bill.   I doubt the forced to buy a policy is going to work- and how is that free health care?  Ins is a for profit industry.

He is self employed- between all the taxes- he actually could go somewhere else and enjoy it.   He works his ass off. Never finished high school.


I mean if you could hear our conversations he is 20x angrier then I am-

Are you saying the rest of us dont work hard?

No one said this solution was perfect. Its a step in the right direction. No one should expect free health care. Nor does this law give that to us. Instead, its exactly what the "people" have been screaming for... affordable health care, portability and the reduced risk of being dropped when you need it most.

Ok- I tell him parts of the country are not as crazy as Chicago is yet.

The US is a big place.   I definitely see him leaving Chicagoland.  He has 2 more houses to flip.
