What difference will it make if you've already frozen to death under a bridge from getting thrown out of your house? You've got a serious crisis right now, today, which you could possibly solve by selling the silver you're hoarding in your basement because some idiots on the radio are warning you that there's going to be a crisis later. But you say you'd rather get thrown out of your home than sell the silver these guys tell you you may need later. How does that make sense to you?

I get this mental image of you sitting in the middle of a burning house, flames all around you, and people yelling "PA! Get the fire extinguisher!" And you sitting there in a burning chair, with the walls and curtains burning all around you, saying, "No, I don't want to use the fire extinguisher up. There may be a worse fire later." Hey, it's your life and your decision to make. You probably can't declare bankruptcy again only 5 years after declaring it the last time, so it looks like your choices are going to be fairly simple - pay the mortgage or lose your home. If you'd rather keep the silver than the house, then I'd suggest going all in right now. If you have any equity in the house at all, dump it for whatever you can get, buy more silver, and pick out a bridge to live under while you wait for society to collapse so you'll be rich again. If that's the choice you're making, make it and be done with it. Seriously. I'm not saying this to be snarky or sarcastic. If you're really making the choice to keep hoarding silver rather than hold on to your home - if you really think that's the best financial decision to make - then make it and be done with it. Why do things halfway? If that's what you believe, go for it. I now this probably isn't what you wanted to hear, but seriously, it's the best advice i can think of given the priorities you've stated, and which sacrifices you are and are not willing to make. Whatever you decide to do, good luck. Sincerely.

Yes, hopefully they will learn that to listen to wacko's telling you to buy silver instead of paying bills that YOU ACCRUED WITH A PROMISE TO PAY and risk losing your home, is a VERY STUPID THING TO DO!

Be VERY glad I am not the creditor you are dealing with........that is all I have to say.

PaHunk, I remember one time when I lived up in N.H. my lawyer once told me that anyone can win a judgement but "collecting" is another matter entirely.
Then he added, "that's why I don't sue poor people." "You can't collect!"

A bankrupcy is not a forgiveness of debt, it is merely an estoppment of collection action. If you owe the money you will always owe the money. That does not mean you can't get credit again. I'm calling BULL SHIT on your post.


A chapter 7 makes ALL unsecured debts go away immediately.  Secured debts with leins that are avoidable also go away immediately.   Secured debts that you are willing to surrender the collateral on go away as well.      And they DON'T come back unless the creditor wants to get his butt reamed in court.

A chapter 13 tries to get the above sorts of creditors paid something.   It may be .01 on the dollar or dollar for dollar.  Typically, it's .20 on the dollar and they ONLY get paid if they file a claim shortly after being notified of the Chapter 13.

At the discharge of either chapter, all but the secured debts are gone by order of law.   Not forgiven, but discharged.



You can file a chapter 7 every 8 years.   You can file and refile chapter 13's back to back, but there are complications if you keep letting your 13's get dismissed and don't complete the plan.

I think he was referring to what is called "judgement proof".

If you don't own any real estate and don't take home a pay check, there is not much for them to garnish through a court system.  They can go after your bank account, but Obama is making moves to prevent that for folks who are on disability or VA benefits or SS benefits as it adds up to a garnishment that skirts the laws against garnishing such income.

If you own property or earn a regular pay check from an employer, creditors can do nasty things to make you pay up.   If you're disabled or retired and don't own real property, there's not much the bill collectors can do other than harrass you with phone calls and rape your credit report.

I Googled PA and what I found said that PA only allows wage garnishmen for taxes AND child support.     However, that doesn't address seizure of bank accounts or judgements on real estate.

I only know Tennessee and don't know all there is to know here.  PA is way outside my knowledge.

The 3rd item is student loans.

3 States a non -wage attachment states.  Tho I think IL there is a limit- of 12% of the check that can be taken.

I was thinking- they don't just kick in your door and tell you to get out.

So they get a judgment?   I send in payments commensurate with my income.   I spell out a monthly budget for myself and make a form on it.
