Lady H is correct. If discovered by police (or spouses) it will be prosecuted as rape. If the person has second thoughts and said you made them sign it, it will be prosecuted as rape. If the District Attorney needs a headline, it will be prosecuted as rape.
But, most of the things we do are subject to the same rules. You can not consent to assault (which would be the least of what most of what we do .. is). The fact is that most acts (other than light play or fuzzy cuffs is illegal. That is just a fact and I don't think it will ever change.
