He didn't talk on his cell phone much until he met me. Once we started seeing each other, he called me at night after 9PM and on weekends. Later, he found out his plan didn't have free nights and weekends like 99% of others and his bill was huge. They refused to give him more than one month to pay and keep his phone on. I advised him to get a prepaid phone, but to make sure to pay the other company every month by check or debit card so it didn't hurt his fairly good credit. He has been doing that every month since his phone was shut off. When he applied for a home loan, he found out the account had been reported as a collection. We immediately went to the cell phone outlet he has always made his payments to (then and now). The employee at the store confirmed my Sir had been regularly paying toward the balance every month and told the bank this so it won't be counted against him, but he refused to tell the collections department the same saying if the store had the info they probably did too. Even stranger, the lady at the bank who ran his credit said the whole thing shows up as a garnishment. Doesn't a court have to set that up? He never got any notice to appear and he's lived at the same address for the last 2 years. I guess the company assumed he wasn't going to pay his bill and reported him without bothering to check the computer to see if he was paying on it. We called the collections department and they claim they sent a letter for him to contact them to make payment arrangements. Of course he didn't contact them since he never received this supposed letter. He just continued paying at the same location he always paid at. Can anything be done to get this off my Sir's credit?

Also, since he used his debit card, we can easily get proof that payments were made toward the balance each month.

Contact the credit bureau and go through their procedures. Start with disputing it. Cali

By the way, they are perfectly correct in reporting him for a deliquent account. He did not pay by the terms of the agreement, which was to pay in full every month. They are NOT correct if they have it listed as a garnishment. Cali

I don't understand that. He has been giving them money every month. There is no failure to pay. Why would a business report someone who was giving them money every month? Do they want him to quit paying them? Collections are for people who refuse to pay, not people who are paying.

Dude! They MUST give you landline service. As in local calls - no extras. You will have to pay the install AND a deposit. DO that today. Then buy a phone card to make toll calls. This is what I mean by the consumer is WRONG. cell bills are not taken seriously by mortage aps. I got no where complaining to my cell- so I took it to the govt agency. I still got no where...but enough complainsts and they wont be able to do business

The bank almost did take it seriously, until the cell phone outlet told the bank VP payments had been made.

I switced to a prepaid cell. It is for 2 minute calls. It has worked out fine for 6 months

UPDATE I just talked to the bank. The home loan is approved and the bank is going to include paying off that bill in the loan. I called the collection agency and talked to a supervisor. They are going to talk to Sir when he gets home and since they are about to be paid off, they want to resolve the matter to everyone's satisfaction. That means either a pay for delete or report to credit bureau as account in good standing....not reported as paid collection. We will have them put it in writing and fax the written statement to the bank before they are paid off. Sir's credit is about to be saved. Also, he never blamed me for ruining his credit. I blamed myself because I'm the one that gave him the bad advice. I was the one saying it was my fault, not him.

def, the fact still remains that the account is delinquent. The fact is, if it is to be paid every month in full it is. Imagine buying a house and the payment is say $500 per month. If you send them $400 per month they will foreclose because you are not keeping up your end of the deal. They have every right to do so. Te problem with cellphones is usage, you don't see the bill adding up. Same problem with utilities, go ahead and crank the AC down to 68 when it is 90 outside, enjoy it, because you WILL pay for it. As far as a house goes, MrSir's rating is down, and for good reason. Hopefully he gets it straightened out, but to them, the fact still remains that he did not pay on time. That is how the world works these days I guess. Really, if the bill is so big he can't pay it, compare that ot the cost of just going over there, or Him coming to you. I really can't figure out why people spend so much time on the phone. T

This is not quite correct on a cell phone bill. Cell phones are billed monthly, not yearly or quarterly, so technically he is in default because he did not pay the montly balance off as the contract states. Paying it off slowly has to be done through a third party which can negotiate that for you. Otherwise he is in default and they can report him as deliquent. Cell phones suck. Yes, making payments is not the same as meeting the, agreed upon, payment plan. When you get a cell phone you make an agreement with the company (aka all that fine print in the contract). When you do not follow the contract agreement regarding payment, you are delinquent. Simple really.

concerning whats happening now with credit...i doubt anyone can get a home loan unless they are millionaires. regardless of credit history. edit:crap didnt read the whole thread...wow he got a home loan during these times in usa...im amazed!

Oh ok. Thanks for the info. I honestly didn't know that cause I've been told by several people throughout my life that as long as a person is making an effort to pay, their credit can't be ruined. I'm just glad it's either getting taken off or listed in good standing (which will show up as a positive).
