LadyEllen, take a gander at what my little brother got for his first, second, and third driving while intoxicated convictions. 

On his first he was 17 years old.  He was driving a '94 Chevy Cavalier and he ran off the road and took out a guy's van in the driveway.  He got fined $500 and sentenced to community service (he had to spend a month picking up trash at the Boy's and Girl's Club baseball fields.) 

On his second, he was 22.  He was driving home and got stopped.  He got fined $500 and lost his license for 6 months.  He spent the night in jail.

On his third, he was in Florida.  Third time in Florida is a felony.  It didn't help much that he had an ounce of cocaine in the car, a couple of hypodermic needles with methamphetamine residue on them, and chemicals used in the manufacture of methamphetamines.  He spent a month in jail down there, and he got his probation revoked here when he returned (he was doing 5 years probation on a felony battery charge.)  He did a year and half in prison.

I shit you not, Greedy.  He only spent a month in jail down there because my parents and I refused to bail him out.  I forgot to mention his charge in 2000.  He stole my old pickup and wrecked it on the way to his ex-girlfriend's house.  She called the cops, and he got arrested for a drunk and disorderly charge.  She got arrested because she had a half ounce of weed on her coffee table.  The cops came to my place and woke me up.  I didn't press charges, and I lied and said he had permission to borrow the truck.  Ain't I great brother?

I have always thought that if a death results from drunk driving the driver should be charged with murder.  It is no different than pointing a gun in a random direction, pulling the trigger and saying, "I hope it doesn't hit anyone."

This guy should have done years in prison and never been allowed the privilidge of driving again for at least 10 years.

Oh c'mon Popeye, you never drove when you shouldn't have?  I know I did; I just didn't get caught.  Shit, I remember driving around the countryside at 19;  drunker than Cooter Brown shooting a .45 out the window at road signs with my buddies.

The sad thing is unbless they KILL someone and sometimes even then they rarely care about what they have done.

I think he shoudl be made to stand in front of the damaged property with a sign that says
I did this because I like to drink and drive
Please thank me for my being so inconsiderate
 
 
I could only wonder how people who are upset about what he did would thank him for what he has done.

Hi Steel

If I add to the story that at the time this road had to be closed due to this, that there were also planned roadworks on two other main routes out of town, unplanned roadworks on a section of road that collapsed (rain washed away the sandstone beneath) and the section of road in question is about the only way to reach part of the town and the western half of the nearby conurbation - and the average delays were 30 minutes (50 minutes peak time)......... well, if they had had him stood there even for ten minutes, he'd a caught it!

I was scrolling down these replies to see if you had given the answer, for I was going to say 'community service', which is another way of the judiciary saying, ' oh the prisons are full, only a bit of room left for people who have done more serious crimes, like tax evasion, embezzelment and any other crime that eats into the security of the funds of the wealthy, oh, and we can't be bothered anyway as we don't live there.'

Yeah, why is it in this country that crimes involving money command a higher sentence than crimes against people ?

I know of a trial of two brothers at crown court for two counts of attempted murder each, they pleaded guilty, and got community service. They were laughing so hard when they left the court, they happened upon one of the witnesses who had flown in from Spain to give evidence, an elderley gentleman. Anyway there was an exchange of words and the elderley gentleman had a heart attack and died on the court steps. The brothers went on to commit further crimes against other people. As you  can  perhaps guess, I have zero faith in UK justice, nor those that have anything to do with it.

I believe that he was referring to the guys who kidnapped and raped the kids rather than the drunk driver.

He should loose his licence and do hard time in the chain-gang style.  His employment for the next several years will be assisting in rebuilding what he destroyed and at night he sleeps sober behind prison walls.

Here in Florida it is possible to get 3-4 DUI's with no jail time. the fines can be prohibitive, but at the judges discretion someone convicted of DUI would not of necessity even have his license revoked. They can instead get a Work License meaning they can drive to work and back or for work. This does not stop them from walking into the bar down the street or the ABC store. In the case of repeat offenders, they can install a control on the vehicle that prevents them from starting the car until after they have breathed into it proving no alcohol. Many get around it by driving a friends car or ....having a friend blow into it.  Many who have had their license revoked, drive anyway. As for insurance, if you are going to drive without a license, why bother with insurance?

The DUI laws and sentencing in California are complex and being arrested is very expensive. A driver faces penalty enhancements for such matters as follows: having a prior conviction within ten years, speeding 20 mph over the limit, having a child under 14 in the car, a blood-alcohol reading over .15% and refusing to submit to chemical testing.
