Howard Dean who is worried about the possibility of neither Obama or Hillary having enough pledged delegates to win the nomination are now considering allow Florida to vote again, this time allowing the delegates to count in the convention.

Winning Florida would likely put Clinton in front of Obama in the pledged delegate count.

Clinton won Florida on Jan 29th by more than 20% of the vote over Obama. But because the state moved its primary ahead of Feburary 5th, the DNC punished the state by stripping all its delegates. The Clinton campaign says it is unfair that the voters of Florida are not being allowed to have a say in the presidential race.

``We're very willing to listen to the people of Florida,'' Dean said on CNN's ``Late Edition'' program today.

Well Michigan isnt mentioned in the story, but I imagine if Florida is allowed, Michigan will be as well. The catch is that the state party and the taxpayers have to pay for the election. Florida's governor says Florida is willing to pay. I guess it depends on whether Michigan is willing to pay as well.

Keep in mind also that Florida Democrats are not giving up.
The Federal District court in Atlanta agreed last week to hear the case on whether the DNC rules that block Florida delegates are unconstitutional. So the Democrats have a legal battle on their hands now that could very well end up in the Supreme Court. The court could say the DNC can't block the votes, therefore the Jan 29th election counts. That may be why Howard Dean is looking for a compromise by allowing Florida and Michigan to vote again if the Florida Dems drop the lawsuit.

The problem here also is that the founding fathers put absolutely nothing in the Constitution regarding the primary elections. So it's basically a free-for-all based on archaic rules made by the RNC and the DNC. Whether the federal courts accept those rules as case law is going to be a question mark that no one has an answer to right now.

This race is likely to result in massive changes to the primary system in the future. Rules will be re-written.

I think letting them vote again is stupid.   I think the DNC screwed up in the first place and should just ride it out.    Costing the taxpayers more money is crazy.   Let the DNC pay for it, including the salaries of the officials.  

I also agree that the rules should be overhauled for Primaries.   Just set a date and hold a national primary election.  Then let the candidates battle it out at their conventions and off to the general election.

I agree with KenDckey.  If the DNC has issues, they can fix them for the next election.

If Hillary loses, she will fight it all the way to the Supreme Court a la AnencephalyBoy.

It will be amusing hearing the right rant about how unfair it all is and how mean she is to do it.

Goes back to the whole short term memory loss thing.

I dont think the GOP is going to give a damn what the Democrats do in the courts. This is the Dems hot potato now. But if you think the Clintons, who have planned this campaign for 20+ years, is going to just simply give up....you are dreaming. They will take this thing to the Supreme Court. They will take it all the way to the convention if they have to. Neither Hillary nor Obama will have enough delegates to win the nomination outright. So Hillary can take it to a brokered convention if she really wants to. The last time something like that happened the Democrats 1952 suffered a huge loss to Eisenhower. And when superdelegates picked Mondale in 1984, he lost a 48-state landslide to Reagan.

The GOP race is pretty much decided unless that one challange succeeds against McCain's eligibility. There is a group that filed a suit claiming that McCain can't run for president because he was born on a military base on American occupied land. The Constitution says you can only become president if you are born on American soil. So that's yet another thing the courts will have to work out. Is American occupied land considered American territory? It's a little hazy. I doubt the court is going to rule against McCain....if they do, the GOP is looking at a brokered convention as well with Huckabee holding a lot of delegate power.

Uhh Sinergy we on the right are praying for Hillary to try to take the Party selection rules to the Supreme court.  That she gets to take the nomination even though the people chose Obama would be incredible.  The idea of the radicals and centrists fighting each other at a disputed Democratic convention, gives Karl Rove a boner.  And gives anyone who wants the Dems to win nightmares.

God forbid someone else other than New Hampshire and Iowa have some influence in presidential politics.

The Florida Democratic party,in conjuction with the Florida Republican party did this.They both new what would happen,and they both did it anyway.
