Tolerance is a luxury afforded by civilization (in its meaning of "living in cities"). The laws of Moses were handed down during the 40 years of nomadic wandering in the desert. What would be more contrary to the aim of raising up an army and multiplying a people than non-reproductive sex, or more disruptive of the good order than promiscuity by married men and other men's wives (given the existence of polygyny). Prosciptions against non-reproductive sex and disruptive behavior were treated the same as thievery and murder, remember the concept of imprisionment for crime and the begining of a punishment less than capital are scarely more than 250 years. That these behaviors are now tolerated and unpunished gives the modern person a skewed perspective.
