Well, from a legal standpoint, the plaintiff had a case. If the law is still on the books, and the alleged crime occurred within the boundaries of said law, then he is in the right. The judges probably felt as though their hands were tied. But, hey, that's what the court of appeals is for. I'm sure the wife's attorney are already preparing their appeal.
