As long as cops are legally allowed discretion about these matters, I don't think they'll bother arresting people for them. Cops are human too and most of them don't care about a victimless crime. Most cops are out to make the world a better place. That's what draws them to the field. How is arresting a woman for having 7 dildos in her closet going to help make the world better and safer? It isn't.

i havent found this to be true at all.  my dad is a cop and ive been to the company bbq.  most cops dont give a damm about making the world a better place.  most cops ive met are the worst junkies there are.  totally hooked on adrenalin.  they get a total rush from fucking with people.  just ask the junkie that the cops role up on and say "your walking funny let me see your shoe"  and when he gives it up they drive away with it, laughing. (true story, told to me by a real junkie).  i once had a cop tell me "shut you mouth, stop being a smart ass,  and answer my partners questions."  so i turned to him and said "how am i supposed to shut my mouth and.....never mind"  he was not amused.  also a true story.

"fuck the police"

Oh that was wonderful, but what else can you expect from a state that only allows blind people to use lasers on their guns for hunting? With a sighted person or not that is absurd...Texas is strange...

Its like being illigal to drive with bare feet. The cops can't see inside your car. Just like their not going to know if you have 6 dildos.

And for the driving record, I have slip-on's in the seat next to me, just in case of pull over. [:D]
Apparely by law this makes me a horrible person. Oh no!

rosanegra -> RE: Texas law- sex toys... 6 dildos felony (1/14/2008 5:04:20 AM)

Man... what happens if your shoe breaks? I've had that happen a couple times with flip-flops/sandals... In Texas, no less!

Thank god I'm out of that wasteland... talk about oppressive.
No wonder there weren't any toy stores in Killeen.

If something truly catastrophic happened in my life and I decided to take down all the people who were so closed-minded, idiotic, and damaging to other people's freedom that it made me feel physically ill... I think Warren Chisum would make the cut.

Kirren -> RE: Texas law- sex toys... 6 dildos felony (1/14/2008 5:43:16 AM)

I can not believe the massive ignorance that passes for legislature in some states.
But, as was stated, there are some old laws still on the books, that people cant have sex in any position out side of missionary.

And as was already stated, its not like the cops can just randomly bust in and get some one for having multiple dildo's.
However, what I do see is this...a cop using the idea that a person could have multiple dildo's as a reason to search some ones house, for what ever reason to find what ever they would need to complete a case, if that makes sense. A kind of cover up if you will.

At any rate, it was funny, and the old lady was classic. I wish My gran would get into sex laws. Little Italian lady chasin an insane senator around with a wooden spoon over a dildo.

I can plainly see that I will NEVER visit texas.

I don't recommend being arrested in Texas.  The U.S. Constitution doesn't apply here.

You're entitled to your opinion. Personally, I fin dthe 99% of the people who say that didn't understand the laws to begin with and have actually been treated in an entirely legal manner.

quote:

I also don't approve of laws made up to assist in getting probable cause for another crime

That's not why they were made up. In relation to THIS law, they were made up to shut down shady sex houses. Just so happens that sometimes and obscure law can be used to nail someone for something else.

quote:

hey either have probable cause or they don't

If they have probable cause for Crime A, they can search your house. If they happen to find evidence of Crime B, why shouldn't they nail you for it? Remember they caught Al Capone for tax evasion. Do you know how many suspected drug dealers and pedophiles have been taken off the streets over finding them guilty of lesser crimes and searching their houses? Or maybe you don't want the police to behave in a pro-active manner and get the dangerous folks off the street.

quote:

One attorney I talked to told me cops are trained how to lie in such a manner that a warrant won't get thrown out.  This state is crazy.  And not in a good way.

That's fucking bullshit. Attorneys are the biggest liars out there, didn't anyone ever tell you that? Especially defense attorneys. C'mon, surely you can't trust someone who's trying to put the criminals BACK out there on the streets.

I'm not saying no cop every lies, but it's the exception and not the rule. Lying is the number 1 thing that will get you fired from any law enforcement related job.

I'm sorry you had a bad experience with the cops, but that doesn't give you the right to paint them as evil and corrupt. I'm sure if you give me the FULL Details of being arrested for "rescuing cats" I can figure out what you were doing that was illegal. But then again you probably don't care...because afterall, everyone thinks they're innocent and the cops are the bad guys.

Of course, as soon as their car gets stolen or their UM gets molested, who's the first person they call?

quote:

(true story, told to me by a real junkie

Please tell me you don't believe stuff told to you by junkies. Please. After attorneys, they are probably the next biggest group of liars.

Um, hello?  Anyone ever heard of "innocent until proven guilty" and "entitled to a defense"?  Are you saying every time someone gets arrested, they are guilty and if they are proven not guilty in a court of law it is because someone was "trying to put the criminals back out there on the streets?"  Seriously?  In that case can't we just do away with trials altogether, and the police can arrest anyone they want and just skip the trial business and go straight to sentencing?

Attorneys are just people - I am sure some of them lie and some of them do not.  Just like some police lie, accept bribes, etc and some do not.

BruisedHick -> RE: Texas law- sex toys... 6 dildos felony (1/14/2008 9:19:27 AM)

Wait....  the justification for this law is that it can be used, if necessary, to book someone when what they are suspected of can't be proven?????

So let's illegalize having two feet.  No one will actually get arrested for it, unless we suspect you of murder.  Then we'll book you for a solid 20 in the big house, not for murder, but for the foot thing.

If you're not going to enforce it, don't have it as a rule.  It only trivializes every other law out there.

Yours,

benji

Like I said, being homosexual is illegal here too, but who has time to go looking around for gay people? Which would you rather the cops do? Go arrest people for having consensual gay sex in private or go solve murder cases and bust narcotic rings? It's a manpower issue..You simply don't have the time or energy to enforce every law on the books.

Or it could be the fact that those laws were struck down.

I believe less than 5% of those arrested are innocent. I believe everyone has a right to a defense, but when you're a laywer and you KNOW your client is guilty but you still look for every possible loophole to let that person go free, then that's wrong IMO. There's a difference between TRUE innocence and technical innocence. Way too many scumbags go free on technicalities, who were really guilty as sin.

quote:

Wait....  the justification for this law is that it can be used, if necessary, to book someone when what they are suspected of can't be proven?????

That's not what I said. I don't think any cops feel there is justification for this law. I think almost all of them think it's bullshit. However, the legislaters, for whatever reason, believe in it.

So, if the legislators are going to put stupid crap like this on the books, then the only times cops are going to enforce it is when it can help them catch a dangerous criminal. If you suspect someone has illegal porn of underage individuals, but you can't prove it....but you CAN prove they have illegal dildos, then why not use the "stupid dildo law" in your favor to get a dangerous pedophile off the streets? It's called being pro-active. Why wait for the pedophile to harm another person? I'm not saying this scenario happens often...I'm just saying it's one scenario that CAN happen.

It's no different than going to a high-narcotics area and doing as many traffic stops as possible in hopes of catching a drug dealer. As long as what the officer is doing is LEGAL and it helps remove scumbags from the streets, why not?

quote:

If you're not going to enforce it, don't have it as a rule.  It only trivializes every other law out there.

Tell that to the legislators who pass stupid laws. That has nothing to do with cops. They don't make the laws...they just enforce them. Maybe if the politicians would stop putting so many stupid laws on the books, the cops would have more time to do real police work.

quote:

Or it could be the fact that those laws were struck down.

Check the TX penal code. It's still on the books.

Alumbrado -> RE: Texas law- sex toys... 6 dildos felony (1/14/2008 9:44:39 AM)

It is not unheard of for unconstitutional laws to stay on the books long after they are ruled unenforceable.

Currently in the US, any laws that attempt to criminalize private consenting sexual behavior, or sexual orientation were rendered  invalid by the USSC.
Some jurisdictions might attempt to enforce them, but they would merely be handing the  persons arrested a get out of jail free card and a ticket for a huge settlement.

Texas isn't too concerned with that silly Constitution thing.

Heh. I saw that. Way funny, especially since I used to live in Dallas. Although I am a pretty politically conservative gal, I do think we all should just mind our own business when it comes to sex...
