Wow. If not for the source, I'd have serious doubts to the story's credibility. Now they're only moderate doubts.

Ah wells. Hopefully that judge will get some time in jail. The collective time he sentenced others to jail, then a series of civil payments for pain and suffering along with other expenses such as possible interest on bail loans and lost wages, and that should do it.

Obviously, the judge was wrong.

That said, I'm so tired of inappropriate cell phone use that I can understand his snapping.

I dont doubt the credibility of the story at all and have seen worse from the bench, although arguably not effecting as many people.

I heard this on NPR.

Personally, I'm of the belief that in a judge's courtroom, the judge is damn near to king as we can get in a democracy.

If I post a sign on my door saying "NO CELL PHONES" and a cell phone goes off, and nobody admits to who it is, I'd chuck the lot of my guests out.

It's not just the guy who didn't admit it; it's the guy in front of, behind, to his left, and to his right that aren't admitting to it.

He over reacted I will grant everyone. But, I get a little sick of this kind of behavior too. I had to go to court a week ago, and I was amazed by the people that show up to court dressed like slobs, talking on their cell phones, wearing hats in court, etc. People just don't have any manners anymore. Now the bailiff took care of the guys wearing hats and folks talking on their cell phones. But he shouldn't have had to. You don't wear hats in a court room or indoors at all if you can help it. You don't talk on cell phones when you are in courtrooms or anyplace where your conversation interrupts other people's business or peace of mind. I don't want to listen to them in theaters, restaurants, or at the doctor's office.

Sounds like a good time to execute a search of all individuals in the court room and too scan the phones for missed calls. A night or two with Bubba saying "You're my little puppy now" should give a very LONG and THICK solution to this little problem.

I hate to do this.

If I were that judge I might have done that, but for like a few hours. The crazy side of me would say that they should all be "processed", that may include being handcuffed for a time and maybe even a strip search. But I don't think I would go that far.

And I would never apologize like this wimp. Get it through your head, this is a court of law here, you do not have a phone, make sure it is off. If anyone calls you listen to the damn voicemail OUTSIDE of the place where justice is to be dispensed by testimony. When people take kids to court, some of them can keep them quiet, others cannot.

If a Mother and a kid were at a trail when I was the judge, and the kid started screeching and interrupted the trial, damn right I would jail the Mother, along with the kid. I would say to the bailiff "Take her to where she can care for the child". That means to a cell. They are not seperated, but the point must be clear.

These proceedings determine what happens to real people's lives, sometimes in a major way. None of us have the right to bring in a nuisance that will disrupt this, this is IMPORTANT ! And if the people sitting around the offender in that courtromm did not at least point to where they heard the ring from, what are they doing there ? If you support the law, or the real Law or anything like that, and do not know that it is wrong to interrupt those hearings, your Mamma didn't teach you much. Sorry about your luck.

Now mind you, in your house you are the law, although you do not have the right to jail people, you have every right to put them out. But these people in the court audience came there willingly, and as was said before, there is a sign right on the door.

Actually, Robert's Rules Of Order are pretty much in force in court. They specifically relate of conduct when in a meeting or a court. They describe when it is acceptable to object or interject.

That being so, you can't bring anything that makes noise in there. It really is that simple. If I were a defendant on trial for my life, and they disrupted the court during my final argument, I would like to see them tried for obstruction of justice.

Don't come to my house unless you follow my rules. Don't go to court unless you follow their rules. I don't see a problem with that. If I am in your venue I will comply with your rules or leave. When in court, certain things are expected. Do it or stay home.

A court is different than being at a concert, bar or dinner party. Actually that judge backing down is much to my dismay, if I were he, I would make the same points I just made to the media. Let the chips fall.

How about a sample statement, one that I might make.." You do not know what you are walking into when you go into a court of law. These proceedings can have profound effects on the defendants' lives. Whenever one corrupts the judicial process, they are almost a traitor. The next step from this is treason.

Notice I did not mention any country here, there is a reason for that.

Rules for town meetings, congress and senate, and courtrooms are all standardized. If you do not want to comply, do not go, unless compelled.

Termyn8or, I don't just think it pertains to other's rules while you are in their realm. I notice people doing inconsiderate things like this all the time. I am not calling for laws to be passed, but there are unwritten laws that we all should follow. For God's sake, if anyone reading this is going out to eat, boarding a plane, or going out anywhere than dress and speak appropriately for the occasion. You don't curse in most public places. You don't wear t-shirts, jeans, and sneakers to a nice restaurant. You don't dress like your going to the beach on a plane. You bathe and comb your hair before you go out anywhere around people. You open doors for women, and you don't accept payment for doing something nice for someone. I really don't understand why people don't know or don't care about manners, social graces, and ettiquette anymore. I only offered a few examples of things that irritate me, but there are many. We would get along a lot better, if we would just exercise some courtesy.

how the heck did a cell get thru security? even in small town court- one must use the main entrance of court house sign in and be searched!

why is it the rooms fault?

the judge should be put in jail for the same amount of time- the collective time. time is money. if someone had touched to person who had it- they would be sued for violation of the rights. tho in America- the entire court room would simply be tasered.

i would have done the same thing. in courtrooms here, you are ordered to turn off ALL electronic devices before entering the courtroom or you will be jailed for contempt of court. believe me - the bailiffs here don't play if they catch you chatting on the phone and/or have a cellphone ringing in court.

the judge did the right thing

Well, actually, the "minding your business" part is part of the problem: The others COULD have pointed out who was making the noise...But they didn't! Complicity is just as bad as direct guilt, right?
Some buildings--courthouse or not--actually confiscate cellphones upon entry, giving them back upon exit...Including the local gym.
I THINK a gym has a lower legal standing than a courthouse, so if a gym can do it, why not the courthouse? Oddly, even in our "rights"-obsessed culture, noone has yet sued the gym!

A judge may wear robes, but he's just another man - just like you and I. He is also subject to all kinds of oversight. It's not easy to get a judge into trouble for his courtroom antics, but it is possible. And it is primarily federal judges that are difficult to remove from office.

I don't actually disagree with you (well, in theory), but I will add that respect is earned.

If courtrooms were still places in which justice was actually sought instead of just a place for the state to trifle with its citizens, then you might have a point.

Today, most courtrooms are merely rooms in which citizens wait their turn to be legally raped.

I was at a funeral Mass last year and THREE cellphones went off. You'd think that after the first one, the other two dolts would have thought about shutting their phones off.

You're quite right; in the case of Robert Restaino (the judge in the OP) he was, in fact, removed for his actions.

I doubt it happened while he was sitting on the bench though
