And he's been bought and paid for by the RIAA!  For those that don't know, a single mother of two children who earns less than $40,000/yr was sued by the record industry for sharing 23 songs.  The jury found her liable and awarded the major labels $220,000.  The truth is slowly coming out: the RIAA's lawyers cherry-picked a jury of clods: prospective jurors were specifically asked if they owned computers or had been on the internet, and only the most technologically ignorant were empaneled.  This allowed the RIAA to snow the jurors, who lacked even basic knowledge about computers and networking.  For example, the RIAA's computer expert (a professor of computer science from Iowa...hired gun) testified that the defense's theory that someone could have hopped on to the defendant's wireless router was impossible.  Why?  Because if she had had a wireless router, her IP would have begun with 192.168.  Um....every 5 year old knows that the router IP is only seen by your cable modem.  The IP that gets reported to the world is the cable modem's IP, not the router.

Wired did an interview with one juror, Michael Hegg, a 38 year old steelworker who admits that he has never been on the internet.

Never been on the internet?  Score one for the RIAA for successfully finding a real live dinosaur!

Well, what kind of idiot do you expect to believe that any music recording meets the Constitutional requirement of Article I Section 8 for special protection?

Ummm...

Where was HER attorney when the jury pool was "cherry picked?"

I hear ya but I also think the punishment should fit the crime and this seems a bit harsh to me. People getting DUI's don't pay this much.

FatDomDaddy -> RE: Dinosaur Discovered Alive in Michigan, Gets Job at RIAA (10/11/2007 7:49:44 PM)

It was not a punishment, she was not convicted criminally in a court of justice. .

This was a civil judgement in a court of equity. A jury (that was chosen by both plaintiff and defendant) found in favor for the plaintiff and then awarded said plaintiff compensation and damages and possibly legal fees.  Comparing it to a criminal DUI is like comparing apples and cinder blocks

Her attorney was most likely the cheapest she could find based on her salary and having three kids.  The record companies attorney was most likely the most expensive.

FatDomDaddy -> RE: Dinosaur Discovered Alive in Michigan, Gets Job at RIAA (10/11/2007 8:47:16 PM)

The cost of an attorney has little to do with said attorney's skill and with such a high profile case, I suspect her fees were pro bono.

FTR, I do think the award was excessive (though I doubt it will ever paid).

Oh and I think you will look smashing in glasses.

Both counsel have the opportunity to pick the jury, actually.

And FDD is correct.  A lawyer's hourly fee isn't commisurate with their skill or lack thereof.  It's more like a 'going rate' for the area they practice in. (Unless of course you're talking about famous attorneys)

Besides, even a good lawyer (if you can actually find one) only has so much control over this shit.  As much as we would like to believe in our legal system, justice has no place in a courtroom and legal statute actually has very little to do with any of it.  It's mostly strategy, the art of bullshit, whether or not you get a judge with a brain, and luck falling in on your side on any one given day.

It still doesn't fit regardless.

Popular Audio Recordings do not meet the Constitutional Requirements for special protection enumerated in Article I, Section 8.

It's ludicrous that this case was ever even filed. But we're in crazy times.

I don't know what happened to you but as someone who deals with criminal courts directly and just about every day, I find that many many times public defenders put up the best fights, hold the prosecution to toughest points of law, come up with more unique defenses and generally work harder for their clients than do a good number of paid attorneys.

And not to paint all paid attorneys, I find  many who work with low income clients are uniquely tuned into their needs, work within the buget of their clients and run circles around higher paid attorneys and prosecutors.

ChicagoSwitchMal -> RE: Dinosaur Discovered Alive in Michigan, Gets Job at RIAA (10/12/2007 8:37:56 PM)

There may be a point to this. Public defenders aren't motivated to milk billable hours and drag things on like paid lawyers are.
