Belmont to be first U.S. city to ban all smoking

Belmont is set to make history by becoming the first city in the nation to ban smoking on its streets and almost everywhere else.

The Belmont City Council voted unanimously last night to pursue a strict law that will prohibit smoking anywhere in the city except for single-family detached residences. Smoking on the street, in a park and even in one’s car will become illegal and police would have the option of handing out tickets if they catch someone.

The actual language of the law still needs to be drafted and will likely come back to the council either in December or early next year.

“We have a tremendous opportunity here. We need to pass as stringent a law as we can, I would like to make it illegal,” said Councilman Dave Warden. “What if every city did this, image how many lives would be saved? If we can do one little thing here at this level it will matter.”

It's going nowhere. We've seen tons of this kind of "Feel Good" crap come and go...

Yes, they are, seeks. This line sticks out:

I have no doubt ol' Dave is genuine in his desire to save lives. But..... where does it stop?

Didn't Carmel by the Sea here in Cali pass a similar law about 5 years ago when Clint Eastwood was the Mayor? I've been there in the interim and was told that smoking in public is prohibited there.

It's even worse than that. The Governor of California just signed into law a ban on smoking with minors in your car. Add to that a bill pending that will ban smoking in all apartments and condos in California, and it seems the slippery slope is now a landslide.
It is interesting how so many who are screaming about how we are losing our rights are so quiet when real rights are actually being taken away. That wouldn't be because of who is behind the passage of these bills would it?

That's only in new builds. This doesn't affect any housing that was built prior to the law being signed. I think it's outrageous and I happen to be a smoker so I'm only adding that for clarification purposes.

so who would by new condos ? only people who dont smoke. seems to me- unless the vent system pumps in.

this wont fly.  smoking is a LEGAL activity.

This will go into effect in January 1, 2008 in CA.

The most interesting quote came from the bill''s author, State Senator Jenny Oropeza (Democrat); "Protecting the health of our children is among government's highest responsibilities."

Is 'Child Worship' is now officially sanctioned as a State religion? If so, I don't know why we are stopping here.

Children are bitten by dogs almost daily. Where is the law banning dogs in homes with children under 18?

Children die in swimming pools. Where is the law banning pools in homes where there is a child under 18?

Children fall and hurt themselves riding bicycles. Where is the law banning bike riding?

The "logic" is that a child has no way to "escape" car cigarette smoke. Linear logic says that they have no control when an auto accident occurs either. The 'State' should also ban children to ride in cars at all.

There has NEVER been a death certificate where "second hand smoke" was listed by the cause of death to any person, let alone a person under the age of 18. There are countless death certificates where the cause of death is drowning, bike accident, car accident, and yes - dog bites.

Are people really so willing applaud the surrendering of their rights, especially the right to raise you child as you see fit? Should the government supersede your authority regarding your children even more than they currently do?

Currently the State already has more control than you realize. You think you have responsibility for you child? Keep them home from the state ordered school system and fail to produce a 'home school' curriculum and see what happens. Better to send them to school where they can get shot, as long as when you take them you don't smoke!

Child Obesity should be targeted as well. Need to close down all those "all you can eat" buffets. All children that appear to be 20% heavier than they should be, should be reported to the Dept of Family and Children Services, or equivilent.

I am a smoker. I do not smoke in my house. I very rarely smoke in my car, and only then when no one else is in it and the windows rolled down. I smoke off the sides of building where there is no foot traffic. On long trips, I will stop and walk away from people to smoke. That is my choice because I feel it impolite to put something in the air that may disturb them, unless I wish to disturb them. Smoking in something I own, or in a place that has no chance of someone else breathing the second hand smoke should be allowed.

I doubt this law will pass a constitutionality test in the courts. Why do lawmakers pass laws they know will be defeated?

What does that have to do with this, fargle?  Pot smoking is illegal (except in the case of Dr. prescribed and then where in the hell are you supposed to fill your prescription?  That always gives Me a big laugh!) )  I can still walk into any convenience mart and buy cigarettes 24 hours a day.  Legally!  When I need to contact My dealer for a pack, then I will probably give this smoking habit of MIne another think. 
The cigarettes are not illegal.  Government, big and small, with the full and smiling approval of the non-smokers, is just trying to make the use of the product illegal.  Why not just get it over with, folks?  *Sigh*
Or could it be that some of you are finally beginning to realize that this is just a first step?
I made these points with these sorts of examples just a few months ago on a rabid anti-smoking thread.  It was pooh-poohed...
Who's next?  What's next?  *Cue Twilight Zone music*  Watch your backs!

I used to smoke weed too. It was the only thing I could use to sleep at night, until I got off the pain pills the docs got me hooked on. Cigs are bad for me, I have quite twice before, and will quit again. They stink, cause health issues and there are other things I can do with that money. For now I will stay hooked on the nicotine.

If protecting children was the reason, there would be a ban on unessential use of private cars, improved public transport and pressure on people to use it. Traffic fumes are by far away the biggest cause of child respiratory problems in the western world. An increase in child respiratory problems have soared while smoking has steeply declined so there is no way they are in anyway linked.

No doubt someone will come up with an anecdote to prove otherwise but while a particular child might be forced to inhale secondary smoke by their problem parents, there is not a social problem other than in the prejudiced minds of anti-smokers. Those liberals that fixate on a problem even if it only exists in their own mind and ignore the real cause of a particular problem.
