actually when I worked for asset protection team (rent-a-cop) we were told to not get involved and record as much information about the situation,
photograph, and call proper athorities. getting involve opens the door to lawsuits.

SHEPHERDSVILLE, Ky. - A jury awarded $6.1 million Friday to a woman who said she was forced to strip in a McDonald's back office after someone called the restaurant posing as a police officer.

Louise Ogborn, 21, had sued McDonald's Corp., claiming the fast-food giant failed to warn her and other employees about the caller who already struck other McDonald's stores and other fast-food restaurants across the country.

Ogborn had been seeking $200 million. McDonald's Corp. attorneys argued the company was not responsible and contended the company was being sued because of its deep pockets.

(Something tells me, somewhere in all this, there's a post about secret sauce).

I'm still trying to figure out  why the girl in question allowed this.
Are there any one of you out there who would comply with directives like that?    I hate to seem harsh, but this girl was awarded 6 million for not using her brain?

And THAT's the real issue here....I've not used my brain on more than 3 occasions, and I never got more than 20 bucks out of the deal.

It may be because, initially, the girl, who at the time was maybe 18?, thought that this was her supervisor and the police, accusing her of a crime, and she thought she had to comply and submit to a search.

By the time the caller's directives were too ridiculous to be true, she was actually being prevented from leaving, had no clothes or phone, and the people holding her were acting totally inappropriately.  Imagine how it would feel, as things just get worse and worse, more out of control, and you're stuck in a little room with this guy and his fiance' looming over you.

The one thing I did wonder, is that she didn't scream for help - I don't know if she would have been audible to customers - or just run naked, out of the room.  But maybe she was afraid it would provoke them to violence.  That wouldn't have been an unreasonable fear.

On the stand, the girl said that she wondered if it was going to be her last day on earth.  I would have wondered, myself, because after these people have committed all these criminal acts, what are they going to do about you not telling anyone?  Even if it really had been a policeperson on the phone, that would actually be even worse, because the acts were still illegal, and if a law enforcement officer were involved...?

Nicely stated.  Saved me the trouble.

I can't even imagine the fear and intimidation this teenager must have been experiencing during something so traumatic.  I'm not sure how I would've handled the situation myself, as I wasn't in her shoes, but my guess is that she did what she thought she should do in order to survive the ordeal.

I saw this report last night and was disgusted over how the supervisor ended up getting money and the way she responded to all of the questions asked of her. She seemed so cold but yet when it came time to testify she was all tears. She deserved time served in jail and NO MONEY

You know, there might be a solution to that.  Maybe there's a civil suit coming, soon, by the victim, against the supervisor.

She can get that million dollars snatched right back out of her perpetrator's hands, along with garnishing her paychecks, for a long, long time.  If she can't seek justice in criminal court, at least she can see that the woman who victimized her doesn't profit from the crime!

I said what I said. Teach your kids to question authority. It isn't always there.

People exceed their authority every day, and others put up with it. Perhaps I see this more because I am the type to question even the jurisdiction of a court. You have to know who the fuck you are talking to. To do this you need the proper upbringing. And people do not have it. People are taught not to question authority.

Funny, as soon as I read that I remembered perhaps my best class in college called "The Social Psychoanalytical Aspects of Clothing." We read of many studies done where the same man/women were dressed up/down then in uniforms of authority and asked strangers for directions. In every case the uniform of authority gained trust and got the requested information.
Scary but true......
We know better thou now don't we...

Jesus Fucking Christ.

Tell your children, if you are told to take your clothes off, it better be in a cold room and everyone there has a badge. These fucking rentacops think they have it all "going on", and supervisors and managers think they are God. What the fuck.

If that girl was my sister I would give her a good talking to and teach her how to say "Go fuck yourself".

A handgun. Once she shot the rapists, the REAL COPS would have shown up soon enough.

With Mc Donalds being a Franchise, where does the responsibility of the Owner come into play? What keeps the owner from having to pay any of this Law Suit? After all, it's not like an executive of Mc D's Corp came down to perform the strip search.

It comes from hundreds of years of "Master/Servant" law. I'm sure anybody who really wants to know about it and the reasoning behind it can find lots on the net.

quote:

If such crimes or pranks where being done to other Mc Donald and restaurants in the area, where was the media and police reports on this one? It's not like every incident and prank is reported to the corporation. Why not sue the police for not warning the community that such pranks where taking place? Did the management staff of these other restaurants also conduct a full strip search on there accused employees? Where they all that dumb to fall for it?

All of which is simply irrelevant to the issue. I'm sure that the media could, in the abstract, cover every report of similar pranks. But they'd have to significantly increase the number of reporters and researchers and it would make for a boring presentation.

As for filing suit against the cops, etc. everybody has the right to sue just about anybody else for just about anything. However, one finds that few decide to sue the cops in cases like the McDonald's one. Moreover, I believe courts have traditionally ruled that citizens are not, as a matter of right, entitled to police protection. Ergo, such suits tend to be dismissed.

quote:

If Mc Donalds is going to keep enduring such Law Suits, it may want to rethink its Franchise arrangements.

This is pro-corporate nonsense. No corporation is going to "rethink" anything of the sort given centuries of Master/servant law. The only rethinking that occurs is after corporations misbehave and have to pay millions of dollars for their misbehavior; the penalties are designed to help them rethink their past actions that cost them millions.

camille65 -> RE: McDonalds must pay for strip search hoax (11/20/2007 5:46:05 AM)

I don't have the link or a source (almost positive it was CNN)but when this story broke it was said that it had happened at more than one location. The corporation did NOT share the information that some random freak was calling stores and trying to set people up. That is where I see where their culpability lies. I can remember being that age and I was indoctrinated with the idea of the cops being Authority. I may not have let it go as far as she did but I would not have immediately said no-go.
