Lesbian couple who wanted baby sue over twins

A lesbian couple in Australia are suing their doctor after they had twin girls from an in vitro fertilization (IVF) procedure when they only wanted one child.

The two women are seeking more than A$400,000 ($340,000) in damages to help pay for the cost of raising the second child, including private school fees, saying they had made it clear to their doctor that they only wanted one baby.

The twins are now 3 years old and the civil case, the first of its kind in Australia, has prompted debate about the value of children and the role of parents.

Ahh, custom genetics. Sue over hair and eye colouration as well.

Is there any form of in vitro that doesn't carry the risk of multiple embryos? If so I've yet to hear of it. More to the point, if these are identical twins how would the doctor predict the splitting of the genetic material?

and one day child #2 will find out about it...wonder if they've they've thought about that? how will their child react when they found out they were so unwanted that their parents sued the dr. that helped bring them life?

I despair at what modern society has turned into; just a bunch of people looking for a free ride by making any claim they can. They will not win this case because if they did it would set a precedent that would open the flood gates for many similar claims. They are wasting their money on poor legal advice that could have been spent on the upbringing of their unwanted child. They could always give one up for adoption but will they?

What’s really sad about this is there are plenty of childless couples struggling to conceive that would think just one child a gift. Sure it’s going to be more expensive but where is this balanced against the joy of seeing another child grow up into an independent individual. If parents only considered the financial impact there simply wouldn’t be anyone wanting to be a parent.

These people shouldn’t have ever been given such treatment because they obviously have a screw loose. Maybe that is their argument.

On the other hand some would say they are doing everything in their power to secure both children’s future and so acting as responsible parents. It’s society’s problem if the law is an ass as they say.

Well, the fact of the matter is that when you have IVF, you are told that the possibility for multiple births exists. Several eggs are fertilized and all are introduced into the womb to improve the odds of having just one child. I don't know about in Australia, but in the States, before you have any medical procedure, you have to sign a document that states you are aware of all the risks. I'm sure that the chance of multiple births resulting from an IVF procedure is included in that documentation. I'd have to ask my sister to be sure, as she has been through the procedure three times, resulting in one live birth.

Doctors will perform ultrasounds to check for more than one fetus and depending on the number, give the parents the option to "reduce", as they call it, the number of fetuses the woman is carrying. As any womn who is the mother of a surprise twin, the ultrasounds and even doppler are not infallible.

These women will not win this suit, providing signed documents exist as previously described, but what happens when those twins discover Moms didn't want them both. Poor babies. How often so many are so self-absorbed that they cannot see what harm they do to their children.

Maybe Australia should sue for custody of both children.

I feel sorry for the twins. One will grow up never feeling wanted and loved. It's the same as telling your children "We never wanted you but here you are and now we're stuck raising you. Aren't we nice?". How sad is that?

On the bright side, they probably can't tell which was the "original". I suppose they'd be more likely to favor one, claiming it to be the real one that they wanted, though.

Kinda funny to think about. Her egg divided.. not the sperm's fault, right? So her bad.

Depends what types of twins they are paternal or maternal etc.

Two sperms one egg
Two sperms two eggs
One fertilised egg that subsequently divides in two

Those are your options for twins I think.
