Actually, it's the DOJ which would handle the indictment. That's why their oath is so damn important.

I can't really see how the fact that it happens in a District Court is an issue, being that the prosecution is initiated by the DOJ, and launched by a Grand Jury...

Sounds more like a bunch of Pussies don't want to do their duty.

Now they are complaining that the Democrats are engaged in a witch hunt.

Fitzgerald is an independant prosecutor. Just because he is on the DOJ's payroll doesn't mean he isn't also working for the judiciary since the indictment will be occuring under the jurisdiction of the judiciary.
If the investigation was occuring under the jurisdiction of the House, then that would be constitutionally acceptable.

Although.....come to think of it....Cheney apparently doesn't think his office is part of the executive, that's what he told Sen. Leahy. So I guess we can cut the VP out of this arguement.
